In the great majority of sales, the closing and tricky-stick- possession dates are! Possession and closing dates are as binding on the parties as price and other conditions, and it is where reality begins. People suddenly realize what they thought they wanted is now imminent; is this really what they want to do? Once their signatures are affixed, at least partial control of their lives has been given to third parties (the agents and the buyers!) Is the date suggested convenient? Some buyers and sellers use closing and possession as a power play to have the last word on something. . . Gosing and possession are two different steps with separate dates identified. Some buyers and sellers (and some agents) dont have a clear understanding of when closing occurs. The approved Utah form states that closing occurs when all necessary documents have been signed by both buyer and seller, and funds have been delivered to the title company. Funds include not only the buyers, but what a lender sends as well. If money is not wired, it must also be in the title companys account overnight. (Utah has a good funds law, closely monitored by the state.)
