Show recommends MUNICIPAL TELEPHONE A athe the meeting g of the city council field e id last evening the committee appointed by the mayor to investigate the matter of a municipal telephone submitted its report the report Is dated april showing that it was formulated many months ago but there were some items the committee wanted to follow a little further and so it has been held until now and then goes in in its original form the committee represented by mr john D peters at the meeting last evening advised the council that the report was wag being submitted to that body in preference to a mass meeting in order that it might be published and the people could have an opportunity to study it carefully then a mass m meeting ee it can be called and general discussion engaged lix in and de definite finate nate action taken it if so desired the report is as follows to the honorable mayor and city council dear sirs we your committee who nho were appointed to investigate the feasibility of brigham city owning and operating its telephone exchange have made some research and formed some conclusions clu we believe it is s practical for brigham city to own and operate its own telephone system we believe that it if the citizens are united the resources of brigham city are of such a character that by careful management a municipal exchange can be installed we bel believe leve from the nature of tr privilege given to the independent telephone co that it wao wa the intention of the city to become the owners and operators of a municipal exchange section 9 provides that the right to purchase the entire plant proper property y and franchise of the grantee herein within the limits of brigham city including the appurtenances appliances exchanges instruments and other property is hereby reserved by brigham city a municipality and said municipality shall have the right at any time it may deem fit to purchase said property and re repossess possess itself of said franchise upon payment of a fair and reasonable sum to be fixed by arbitration or by a judgment of a court of competent jurisdiction ton thereof the gran grantee tep herein and its successors and assigns by bi acceptance hereof expressly i consenting to such condemnation for the purpose of fixing the purchase price of its said property we believe that an exchange which be sufficient to supply the present needs of brigham city and for five years rears growth could be installed for a fum riot not tt exceed Ws we pre are led to believe that neither the independent nor the bell tele hone abone companies considered their con tr arct ct with nith the elev very binding as thare Is nothing to show that the city was considered in the matter of franchise or joint ow ownership n of poles or any other matter when the sales were made we believe however in as much a as the mountain states telephone company who are operating in brigham city from the tact fact of having purchased the equipments formerly owned by the he bell telephone and the independent companies that they should be made a tender and the city should make an effort to purchase their plant as provided in section 9 of the independent telephone company franchise As to franchises we believe that no privileges of a monopolistic nature should be granted ly by brigham city without the same has been regularly published and the people leople given an opportunity to vote upon the granting of such privilege respectfully submitted JOHN D PETERS ROLAND A MADSEN NELS JENSON |
