The five board members voted privately by notation and with no debate, reaffirming a tentative regulation approved last March, CAB officials said. The board did not announce the vote but Chairman Daniel McKinnon said he and two other board members favored the rules. McKinnon, who held the swing vote, said in a statement that he still believes that smoking should be banned on at least short flights but added: The two-hoflight restriction just so complicates airlines schedules, hubbing and enforcement that I became convinced that it would be impossible to implement. The rules will go into effect 30 days after they are published in the Federal Register later this month. With Medicare costs soaring to a projected 76 billion next year, the government is eager to take advantage of the HMOs reputation for care for less providing money. The government is offering favorable rates as an inducement for HMOs and variations of prepaid health plans to seek out and sign up some of Medicares 30 million beneficiaries. The Department of Health and Human Services expects up to 600,000 Medicare patients to make the switch in the next three or four years, lured by the possibility of getting more service for less money. Instead of paying fees to physicians for services rendered, HMO enrollees pay a fixed fee in advance and the HMO agrees to provide all health services without charging large, extra deductibles and copayments. LOS ANGELES (UPI) - John De Fri- day as his attorney launched a bare knuckles attack on the government's star witness and traded barbs with prosecutors, prompting the judge to threaten the lawyers with jail. I dont want to see any more outbursts like we experienced this afternoon, U.S. District Judge Robert Takasugi told attorneys after jurors left for the day. Otherwise, well be adding to the inmate population. Please be careful. Im not running a nursery school. The warning came after a day of rancorous exchanges between defense attorney Howard Weitzman and the prosecutions chief witness, James Hoffman. Hollering and laughing sarcastically at some responses, Weitzman managed to trip Hoffman up on several inconsistencies in his testimo- tion.; Among the advantages of HMO enrollment is knowing in advance whatpayment is required for health care,; which is important to people on fixed incomes. The government estimates that Medicare beneficiaries would pay a flat monthly premium of $20 to $50, depending on the projected use of medical services by all Medicare patients enrolled in a particular HMQ. The premium is paid regardless of how well or how sick the beneficiary is in the subsequent year. Its something that should he considered. It has the potential for a lot of benefits, said Bernard, Truffer of the governments Health ny. But Hoffman, the informant whose tip launched the drug sting that ended in De Loreans October 1982 arrest, stuck to his basic story: that De Lorean approached him in June of that year and asked him to assemble a multimillion dollar drug deal. Care Financing Administration, which runs Medicare. By contrast, Medicare beneficiaries using the present system are required to pay a $356 deductible when they enter a hospital, but treatment is free through the 60th day. After that, beneficiaries pay $89 a day to defray some of their hospital costs. After 90 days, they pay $178 a day. . Prescription drug costs are covered during their hospital stay. Medicare beneficiaries can also join a supplemental insurance program and pay a $14.60 monthly premium that covers doctors bills. The best candidates for an HMO plan are Medicare beneficiaries who are sickly or require frequent medical attention, who stay close to home atd who need the supplemental services that an HMO might offer but which Medicare does not, such as eyeglasses and dental care. Peggy Pond of Group Health Association of America says a person who spends six months in New York and six months in Florida every year would not be a good HMO candidate, unless the health plan was part of a national chain that has easily accessible branches in both His arms folded and face flushed, Weitzman appeared to grow increasingly frustrated as Hoffman, undergoing a sixth day of parried the defense lawyers hostile questions with flippant remarks and an occasional smile. n, Takasugi admonished Weitzman at one point for dropping the courtesy title "Mr in addressing Hoffman and later for the rapid-fir- e questions he leveled at the witness. Mr. Yeitzman, give Mr. Hoffman a chance to finish his answers, the judge said. He also admonished Hoffman on several occasions for giving apparently evasive answers. The prosecution protested numerous times that Weitzman was "badgering Hoffman, and accused the defense lawyer of being "argumentative and making "gratuitous remarks. At one point, prosecutor James Walsh yelled, If he Weitzman would allow the answer to be given, we wouldnt be going through this circus. Hoffman, 43, k a cocaine smuggler who turned informant to avoid prison, set off the governments investigation of De Lorean by telling his supervisory agents about the exauto magnates alleged desire to enter the drug trade. The defense claims Hoffman framed De Lorean to enhance his worth as paid informant. In Fridays most heated exchange, Weitzman accused Hoffman of lying to tl a grand jury that indicted De Lorean about when cocaine was first discussed. Referring to a transcript of the grand jury hearing, Weitzman pointed out that Hoffman told the panel he and De Lorean first discussed cocaine in September 1982, and not July 11, 1982 as he has testifed. "This was not true, it was a lie, wasnt it? Weitzman shouted at Hoffman. It wasnt a lie, it was an error in my timing, Hoffman retorted. It was my first time before the grand jury. I was nervous. Pastora, who heads the Costa Rica- n-based Demo- Revolutionary cratic Alliance, known by its Spanish initials as ARDE, suffered burns and shrapnel wounds when a bomb exploded during a news conference he was holding at his headquarters just inside Nicaragua across the San Juan River from Costa Rica. Spokesmen for Pastoras organization said late Friday that two people, both ARDE guerrillas, had perished from wounds suffered in the attack, raising the death toll to six. The Costa Rican government, trying to remain neutral in the Nicara- guan conflict, had expelled Pastora last year, and he went into the jungles of southern Nicaragua to lead his guerrillas against the Sandinista government. After the bombing, Costa Ricas National Security Council issued a statement saying it had opened its border to receive, without discrimination of any kind, all the wounded who need medical attention in hospitals. But the Costa Rican information minister, Armando Vargas, said Thursday that Pastora had been placed under police guard at the Biblical Clinic, a private hospital in San Jose, and would be expelled as soon as he had recovered sufficiently from his wounds. At about 3 p.m., Pastora and Chamorro were taken from the hospital through a back door on stretchers carried by Red Cross personnel. They were placed in an ambulance for the trip to the airport as about 200 people, some shouting Viva Pastora!" were waiting in front of the hospital. Pastora made no comment to reporters as he left the building or at the airport, but his cousin Orion Pastora met with journalists in the hospital lobby. He read a statement saying it was the rebel chieftain's decision to leave the country, and it was not made because of any pressure from the Costa Rican government. He also expressed condolences to the other victims of the explosion and gratitude to Perez for making arrangements for the airplane. An offial at the Biblical Clinic said Pastora, 48, suffered first and second-degre- e burns on his chest and had pieces of shrapnel in his face and legs. Linda Frazier, 38, a native of Portland, Ore., and a reporter for the English-languag- e Tico Times newspaper, was one of the six people killed in the blast. She was the wife of Joseph B.
