The U.S. Court of Appeals for the said District of Columbia, ruling Mitchell could not be sued by the 2-- radical Jewish group because it was not clearly established" that the attorney general violated the law. Relying on a 1982 Supreme Court decision, the appeals court said Mitchell could not be sued unless he violated clearly established statutory or constitutional rights of which a reasonable person would have known." When the wiretaps were connected, the court said, it was unclear whether the attorney general had to obtain a warrant when he determined national security was threatened Mitchell was sued by several members of the Jewish organization after they discovered in June 1981 that they had been subject to war- rantless telephone surveillance since October 1970.
