But he expects an agreement will be reached by January allowing Park City Community Clinic to remain open. The bungling referred to Thursday by health director Frank Singleton is by the State Department of Health which is charged with administering all Title 10 federal family planning funds in Utah for the first time this year. Previously, the money went directly to Park City Community Clinic and Planned Parenthood of Utah. The state agreed to contract with the community clinic in November for family planning services and Summit County commissioners signed-of- f the agreement. But this week health department officials said they could not contract directly with a private agency. Instead, they want to contract with Summit County which would subcontract with the community clinic. Negotiations Broke Down When negotiations broke down with the state Tuesday, clinic director Diana Maxell said she might have to close the clinics doors in January if funds arent received soon. The problem is the agreement reached betweenthe state health department and Park City Community Clinic is contrary to the legislative intent of Senate Bill 3 that required parental consent before birth control devices could be given to minors, according to Dr. James Mason, health department director. Dr. Mason, who wasnt aware of the agreement reached between his department and the clinic until this week, said it failed to meet legislative intent. I think the language in the bill is flexible enough for the agreement to work, Mr. Single-to- n said. What our commission is concerned about is that if the state disagreed they should have let us know right after we wrote the agreement in November, not mi Dec. 14. Responsible for Funds Summit County Commission would be responsible for family planning funds if they contract with the state and subcontract with the community clinic which want to do, Mr. , they really dont Singleton said. The county doesnt want the program but they dont object to Diana having it as long as she obeys the law, Mr. Singleton said, referring to Senate Bill 3. While agreement is possible between the three entities, it will take time and the clinic is already almost insolvent. Talk to Mason First We didnt come to any conclusions at todays meeting, Ms. Maxell said. But were still talking and Im optimistic that we will work something out. j - Stations Local 2:30 a.m. Movie: "Redllne 7000," James Caan 4:25 a.m. Movie: "Accused of Murder," David Brian Advertisement 17, 1982 Ell Clinic in Park City To Remain Open? . Viewing Todays Television The Salt Lake Tribune, Friday, December Bungling Slows Agreement The County Commission doesnt object to subcontracting with Ms. Maxell but they would like to talk to Dr. Mason first, Mr. Single toil said. But Dr. Mason said he sees no reason to meet. The commission refuses to consider an agreement until it knows more about the legislative intent language, Mr. Singleton said. Theyre also concerned because they set the new county budget Wednesday which will have to be changed if the contract is approved. I can afford to spend weeks negotiating but Liana - or Two Accidents The incident actually two sepaoccurred near the 650 North off ramp of Interstate 15 in Clearfield. It had been snowing causing icing and slick conditions on the freeway. The Sidell and Gottchalk vehicls were apparently involved in the first accident. While a Utah Highway Patrol trooper was investigating that crash, a pickup truck began to slide on the road. The driver regained control, but not before behind him causing a semi-trailto jackknife and hit another vehicle. While the total grant was normally given to the clinic, the state said they will pay 830 per patient per year rather than a set fee. Costs Are Still There Whether we get the anticipated number of clients or not, the costs are still there, Ms. Maxell said. The original decision which gave funds to the state was appealed to the U.S. Court of Appeals and will be heard Jan. 24 in Washington, D.C., Ms. Maxell said. If the outcome isnt positive, other options will be explored. Were exploring all of our options but we need money now to operate until the appeal goes through and I see state funding as the best option now available, she said. Other options include becoming a private agency or affiliating with Planned Parenthood of Utah. However, neither of those solutions would provide subsidized services for people who cant afford family planning. r SAVE SALE! We have excellent private care in this community but 80 percent of our clientele receive subsidized SNOW THROWERS care. Because the state grant may not be large enough even if it goes to the clinic, Mr. Singleton said it might be possible for the clinic to save rent by moving in with the countys health and social service complex. As a proximate result of the negligence of the defendants, the heirs of Russell D. Sidell have been deprived of the society, companionship, affection of Mr. Sidell. She claims those heirs have been deprived of the financial support and services of Mr. Sidell in the amount of $250,000. She also states that damage in sum of $100,000 was incurred as the result of loss of income from the victim. Mrs. Sidell is also asking for money to pay for medical expenses and the burial of her husband. A second part of the lawsuit involves mental and physical injuries Mrs. Sidell incurred as a result of the accident. She is asking for $85,000 to offset those injuries.
