Show "GAT CAME BACK" ' DOG "HIT OUT" Once I had a little dog, Where is that dog gone now? Hans Peterson. Hans Peterson lost his dog last month and has not seen him since. The last time he saw him Wren Smith was shooting at him, so he says, so he thinks Smith must have killed him. He tried to settle with Smith, or Smith did with him, one or the other, for $10. They failed to settle and Smith was arrested for killing the dog. The case was tried Monday before Judge Sorenson. The evidence of the prosecution was to the effect that as they passed Smith's place with a load of hay Smith came out and began shooting shoot-ing at the dog. They thought he had been hit. That was the last Been of him. They later discovered a place near where the dog was last seen where there had been a fire and they thought the dog had been burned there. The testimony of Smith and his wife was that on the day mentioned a dog came into their yard and went into a nest of eggs, then left that and grabbed a chicken. During this time Mrs. Smith had seen the dog and called to Smith who came out with a rifle and as the dog ran he shot at him twice. The dog dropped the chicken and ran away. And as in the testimony of the other side that was the last seen of the dog. County Attorney Dickson prosecuted and U. E. Curtis defended. They both made long and able arguments. The Judge decided that as there was no positive proof of the death of the dog the defendant was "not guilty. " The trial of the case took nearly all day and there was a good attendance. |
