came up for hearing bearing in justice christ eisens court on oa thiea bues morning at 10 at which time the defendant appeared without counsel and ana pleaded not guilty to the charge city attorney AV B R davis conducted the prosecution and mr paulos was advised that he could have someone represent him but the gentleman declined the services of 0 an attorney stating that mr air if J holt who was present in the court room would be agreeable as counsel if he he would act mr mr holt consented to the proposition and took his seat beside mr paulos the first witness called was marshal valentine who testified to having served a search and warrant on mr paulos friday evening and looked oner his premises finding a number of empty beer bairens and twenty seven bottles of beer in a tub iced which lie he confiscated also testified mat mr air paulos had stated stated that he paulos had bad let some some of the boys have beer b eor at exactly what it cost him as he did not want to make anything on it mr air john deputy sheriff was the next witness and he testified to having walked back through the alley between the state stat bank and armedi armeda block to the rear of the perfection store where did what he did as a matter of accommodation to the traveling men attorney davis in summing up read the ordinance recently passed by the city council which makes it a misdemeanor to sell exchange barters barter dispense serve give away or keep for sale any intoxicating liquors and he be pointed out that the prosecution had proven by the three witnesses that defendant had sold dispensed and less leas than fifty dollars nor more than two h huri ud dred and ninety nine dollars or by imprisonment for or not less leas than thirty days nor more than six aai months or by both such fine and imprisonment the city attorney concluded by stating staling that tho the prosecution had made its case beyond question and aad the justice had the law before him to guide him la in passing sentence mr
