Show SOUTHERN UTAH NEWS WEDNESDAY MARCH 24, 1999 Opinion Guest Editorial 4 I This guest editorial clarifies the BLMs interpretation of the agreement it recently signed with Kane County. Dear Commissioner Carroll, As a result of our recent discussions about the proposed Agreement of Operational Support I am writing to clarify some questions about the section of the agreement dealing with roads. First of all, I will reiterate a point we have discussed several times in the past. The agreement we have signed is simply a statement of intent to work on the details of those elements outlined in the agreement. It is not a legally binding document on the part of either party, until it is adopted as part of a court settlement. If we do reach final agreement on FLPMA Title V rights-of-wa- y and Memorandums of Understanding as listed in the Agreement of Operational Support, these documents will be the basis of an out of court settlement for the pending litigation. Any written documents approved by the District Court, will become the legally binding documents in this proposed agreement. Even if the Court approves the documents in our agreement as a settlement of the pending litigation, that does not mean those can never be amended. The draft state: By written agreement, the BLM and the County may provide for minor changes in the alignment or travel surface in the right of way described in this grant to address unexpected changes in road conditions created by weather or other natural causes and which present a direct threat to public health and safety. Substantial deviations in alignment or travel surface for the above reasons will be handled in accordance with 43 CFR 2803.6-1- . Changes, as recommended by the County and its engineers, are therefore possible under the proposed agreement.
