Show NEW HOMESTEAD LAW follow ing is a complete text of new homestead bill agreed upon by the western senators and senta m congress and s will be the law that will be passed regarding the increase in the acreage apparent ly there is no opposition to it and if passed as it reads below will bo of great benefit to the people of emery county and in fact in all the states where it becomes applicable section 1 that any u who is a qualified knoer the hon e stead laws of the united states may enter by legal sub inions under the provis ons of th s act in the states of colorado california idaho montana nevada north dakota oregon utah washington and and th ter antonea of arizona and nw exico acres or less of non mineral non irrigable unreserved and abed surveyed lands which do not contain merchantable timber lo 10 bated in a reasonable compact bod and rot over lm lesin extreme length section 2 that any person applying to enter land under the provisions of this act shall make and be fore the proper officer an affidavit as required by sect on 2290 leased statutes and in addition thereto shall make affidavit that the land sought to be entered is of the character cha described in section 1 of this act and shall pay the fees now red to be paid under the homestead laws sec 3 that any homestead entry man now occupying lands of the charac ter hereinbefore described heretofore entered by hm upon which anal proof has not been made ahall have the right to enter bubli lands subject to the pro visions of this act lying cont to his farmr entry wh ch shall no to gather with the original entry acres and residence upon an 1 culli of the or ginal entry shall be deemed as residence lesi dence upon and culli vat on of the additional antly sec 4 that at the time of making final proof as provided in action 2291 revised statues the dundei this act shall in addition to the proofs and affidavit required under the said sect on prove by two credible witnesses hat at least one eighth of the area cm graced in his entry was continuously cultivated to cultural crops other than native gra ses begian ng with the second year of the entry and that it east ore quarter of the area embraced in th entorf was so continuously culli bated beginning with the third of the entry sec 5 that noth ng herein contain ed shall be 1 eld to affect the r of a duj fied to make homestead entry in the states named in section 1 of this act under the provisions of sec tion 2289 revised statutes but no person who has made entry under this act shall be entitled to make homestead antly under the provisions pio visions of said sect on and no entry made under th s act shall be commuted sec 6 that er in the ion of the secretary of the interior con editions are such particularly by reason of the anabil ty of the antly an to ob thin a supply of water suitable for domestic purposes as to make conom bous res dence upon the lands entered under this act as a ser ous handsh p he may in h s discretion with n territory clearly described by him accept evi dence of continuous residence in the vicinity of said lands as equivalent to residence upon the lindo provided that m that event the must show good faith b the cultivation of such additional area not less than one half of his entire entry as may be pre scribed bv the secretary prouder further that no such relief from the ne essit of ies dence upon the land shall be granted except upon tracts within areas ds gnatek by the secre tary of the interior within six months of the date of entry of such lands |
