SANTA FE FINED FOR REBATING assess orr each count mak ing a total of bos angeles cal judge olin well born in the united states court on thursday fined the topeka santa fe railroad corn pany for rebating the fine was what the denominated an intermediate penalty the maximum which might have been assessed be ing 1 30 and the minimum 66 the court reviewed the case in written opinion of some length in it stacee that there were sut doubtful and extenuating cir cum stances to preclude the possibility of a maximum sentence and yet suf focient intention of wrongdoing shown to make impossible a minimum pen alty the santa fe company was convicted on october 11 last by a jury in the federal court of granting rebates to tue grand canyon lime cement company of arizona it was found guilty on all of the sixty six counts charged in the indictment setter but an hour s deliberation the re bates were given on shipments of lime and cement aiom nelson ariz to los angeles ranged in amounts from 35 cents to 15 the company claimed that these amounts wei e not rebates on the regular freight rate but were in the form of damages to goods shipped which were allowed after such clavins had been regularly presented and firoved in each instance
