NOTICE OF SALE The Bureau of Land Management offers for sale 17 head of mixed age, mixed gender hereford cattle. The cattle are located in Carbon County, Utah, along the west bank of the Green River in an area known as Gold Hole. The legal description is SLM,T.11S.,R.18E. Sections 9, 10, 11. Access to the area is limited, with the nearest four wneel drive trail being a minimum of three miles from where the cattle are located. Access is available by river boat and horse back or hiking over difficult terrain and topography. The cattle are confined to an area of approximately 400 acres but are otherwise free roaming. TIME AND PLACE OF SALE Sale will be by oral auction held at nine oclock A.M. (MST) on November 3, 1989. Sale to be held in the conference room of the Bureau of Land Management Office located at 900 N. 700 E., Price, Utah. Bidders must be U.S. citizens 18 years of age or older. TERMS OF SALE 1. Cattle are offered for sale on an all or nothing basis. Bids are to be offered per head for the total 17 cattle. In the event there are fewer than 17 cattle present, refunds will be on a per head basis. In the event there are more than 17 cattle present, additional payment is required. buyer must remove all cattle from public land prior to sunset on November 17, 1989. The buyer will destroy on location any cattle that cannot be removed. 3. Cattle are offered as is, where is. The BLM makes no guarantee as to the condition, health or value of the cattle beyond which is in this Notice. At least three of the cattle are lame. The buyer recognizes the hazards of handling wild cattle in difficult terrain and accepts all liabilities connected with the removal of the cattle. 4. Cattle are to be removed or destroyed in a humane manner. 5. The successful bidder will notify the Price River Resource Area Manager in advance of any attempts to remove the cattle. The BLM reserves the right to have observers present no 2- .The during any removal effort. 6. The successful bidder is responsible for arranging and purchasing a brand inspection. 7. A performance bond in the amount of $5,000 must be posted by the successful bidder. The successful bidder will forfeit the bond and puchase price if all the cattle are not removed or destroyed on or before November 17, 1989. Cattle on the location after Novtmber 17, 1989 revert to the BLM. The bond will be held until the BLM verifies no cattle remain in the area (not to exceed 30 days). 8. The bond must be posted and purchase price received at the Price BLM office prior to 4:30 p.m. on the day of the auction. Payment is to be by certified check or cashiers check or postal money order. 9. The BLM reserves the right ti reject any or all bids or withdraw the sale. 10. These terms of sale are final and nonnegotiable. ORDINANCE NO. 89-00- 9 AN ORDINANCE PROVIDING FOR ENFORCEMENT OF CERTAIN VIOLATIONS OF THE ANIMAL CONTROL CODE BY CIVIL PENALTY AND SETTING FORTH THE FINE SCHEDULE FOR SUCH VIOLATIONS. BE IT ORDAINED BY THE PRICE CITY COUNCIL: Section 1. Addition of Code Sections. There is hereby added to the Revised Price City Municipal Code 1988, Chapter 6.16, Sections 6. 16.0 10 through 6. 16.030, which are to read as follows: CHAPTER 6.16 ENFORCEMENT BY CIVIL PROCESS ANIMAL CONTROL Sections: 6.16.010 Code Adopted Civil Penalty and Fine Schedule 6.16.020 Violations 6.16.030 Appeal Procedure 6.16.010 Code Adopted. A. That certain code book, entitled Animal Control Code of Price City, Utah, of 1984, published in book form, three or more copies of which are on file in the office of the City Recorded for the use and examination of the public, having been previously adopted as the Animal Control Code of Price City, 1984, is by this reference made a part of this chapter to the same effect and intent as if that Code were copied herein, in full. B. Three copies of the said Animal Control Code of Price City, Utah, 1984, are now on file and will remain on file for examination and use by the public, in the office of the City Recorder. 6.16.020 Penalties. A. Any person violating,-causinor permitting the violation of any provisions of this chapter shall be liable for a civil dollars ($25.00). Any penalty assessed penalty of Twenty-fiv- e herein may be in addition to such other penalties as may be provided in this Title 6 of the Price City Code. B. Any penalty that is paid within twenty (20) days from the date of receipt of notice shall be reduced by the sum ofTen Dollars ($10.00). C. Any penalty that remains unpaid beyond thirty (30) days from date of receipt of notice shall be increased by the sum of Ten Dollars ($10.00). D. Any penalty that remains unpaidbeyond sixty (60) days from the date of receipt of notice shall be inceased by the sum of an additional Fifteen Dollars ($15.00). 6.16.030 Appeal Procedure A. Any person having received notice of a violation of this Chapter may appear before the Citys hearing officer to contest the alleged violation. B. The burden to prove any defense shall be upon the person raising such defense. C. If the nearing officer finds that no violation occurred or finds that mitigating factors justify leniency, the hearing officer may dismiss the notice of violation or reduce the the penalty associated therewith, but in no event shall such penalty be reduced below the sum of Five Dollars ($5.00). D. If the hearing officer finds that a violation occurred and no applicable defense exists, the hearing officer may, in the interest of justice and on behalf of the City, enter into an agreement for the timely or periodic payment of the applicable penalty. E. Ifthe penalty imposed pursuant to this chapter remains unsatisfied after sixty (60) days from the receipt of notice, or ten (10) days from such date as may have been agreed to by the hearing off the City may use such lawful means as are available to collect : vrh penalty, including costs and attorneys fees. Section 2. Severability. The provisions of this ordinance and the provisions adopted or incorporated by reference are severable. Section 3. Repealer. The provisions of other ordinances in conflict with this ordinance are herby repealed. Section 4. Effective Date. In the opinion of the City Council of Price City, it is necessary for the preservation of the peace, health, and safety of the City and the inhabitants thereof that this ordinance take effect immediately upon publication.
