Show 12B Thursday, October THE GREEN SHEET 22, 1987 700 AN ORDINANCE ESTABLISHING REGULATIONS FOR SWAP MEETS FLEA MARKETS THE AND WHEREAS, the ordinances of Midvale City do not contain rules or regulations governing the operation of swap meets and flea markets; and WHEREAS, it has been determined by the City Council of Midvale City that it is in the best interest of the residents of Midvale City that an ordinance be enacted to govern the activities of swap meets and flea markets. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF MIDVALE CITY, STATE OF UTAH as follows; SECTION ONE: Definitions. of this ordinance: For the purpose A. "Flea Market" means and shall be sidered a swap meet. B means any person "Swap meet licensee who rents, lends or leases his premises to use for as a marketplace sellers temporary to barter and exchange goods. con- SECTION THREE: LicenseApplicationInvestigation. Application for a swap meet license shall be made to the license official, and shall state thereon the name of the applicant, the place of business, and the number of employees intended to be engaged. The Chief of Police shall investigate each applicant for such license, and shall report back to the City Council whether or not such applicant is a peson who has been convicted of the offense of receiving stolen goods, burglary, larceny, or robbery; the license of any sw ap meet licensee who is presently in business and so convicted shall be revoked. SECTION FOUR: LicenseFee. The annual fee for a swap meet license shall be $40.00. The annual renewal fee will be based on the gross receipts of the business. SECTION FIVE: Swap Meet LicenseeRight to Issue Daily Business License. A swap meet licensee shall have the right to issue daily business licenses to resident sellers upon receiving the required fees, and the signed, certified license applications listing the goods to be sold or exchanged. SECTION SIX: Pawnbroker Restrictions. No swap meet licensee shall conduct the business of pawnbroker without having obtained the licenses required for such dealers in addition to his swap meet license. SECTION SEVEN: LicenseRevocation. In addition to other penalties provided by law, any swap meet licensee violating the provisions of this ordinance may have his license revoked or suspended. SECTION EIGHT: Posting of Regulations Concerning Lost Property. It is unlawful for any erson to conduct a swap meet unless he shall eep conspicuously posted in his place of business copies of this ordinance and Section Code Utah Annotated, dealing with lost property converted by a finder. SECTION NINE: Sales Subject to Law 'Prohibited Sales Designated. All sales shall be in accordance with law. Sale of firearms, pyrotechnics, ammunition, explosives, alcoholic beverages, medicines, obscene materials, drug or sex paraphernalia will be proparaphernalia hibited. No seller under the age of eighteen shall be entitled to sell or dispose of goods at the swap meet without the written, notarized permission of his parents or legal guardian. TEN: Sellers' Licensing Re- quirements. A. All sellers shall apply for a license to sell on the premises of a swap meet licensee. Along with the fee of two dollars per sale day, each seller must furnish to the swap meet licensee a signed statement containing the following information: IN THE CIRCUIT COURT OF GREENE COUNTY, MISSOURI, PROBATE DIVISION. Uniformed category 1 peace officers of Midvale City shall be hired by the swap meet licensee to be present at each swap meet to insure that the provisions of this chapter are complied with and that other applciable City ordinances and State statutes are not violated. The number of officers required shall be as follows: 1. One officer shall be required for all swap meets with 25 or less one-da- y licensees. 2.
