An even bigger than anticipated kindergarten class kept Granite districts personnel department hopping Monday to work out staffing difficulties. While actual attendance on Monday was almost 2,000 less than expected, there were 6,307 first-yea- r youngsters, against projections of 6,225. Traditionally enrollments build, especially after Labor Day. Last year Granite picked up 2,697 students between the first day of school and the Oct. 1 nationwide enrollment reporting date. There were 61,938 on hand Monday and if 2,700 more attend by October, that will increase the enrollment beyond the 64,635 projected. An ordinance strengthening the Police Departments ability to hold onto articles which they suspect are stolen was approved here Thursday by the City Council. The council unanimously endorsed an ordinance which makes it a criminal offense to knowingly possess articles on which identification numbers have been altered or obliterated. Approval followed a discussion in which several council members appeared concerned that the power extended in the ordinance might be too and that innocent residents possessing articles without serial numbers might be subject to arrest under i s provisions. But City Attorney Ron Greenhalgh said the ordinance gives the police and prosecute.. a great deal of discretion. I dont foresee any innocent people being arrested, although the potential is probably there. He added, The potential for abuse is there, but many of us feel safe to give the police those powers. He contended the courts would prevent abuse of the power by police. The key clause that came under council scrutiny stipulated that a person commits a crime by possessing articles with altered serial numbers provided the person knows or reasonably should have known that the identification number or marks has been altered or obscured. wide-sweepin- g Earlier in the week, law clerk Keith Stoney said the ordinance will give police greater leeway in cases where persons are arrested for possession of stolen materials. In many cases, he said, police are not able to confiscate articles which they are certain (but cannot prove) have been stolen because there are no identifying marks on the articles and they cannot be identified. As a result, the articles remain in the possession of the suspected thief or fence. The new ordinance, however, makes it a crime to possess those articles if they do not have a serial number, thus allowing police the council. But, Councilman Larry Bunkall Ive bought second-hannoted, stuff before and never checked the numbers Greenhalgh assured him the prosecutors office would screen the cases carefully and not deal with that type of situation. Responded Bunkall: As long as we have honest people in office, were okay. How do we assure the law isnt misused in the future? That's what the courts are there for, arswered Greenhalgh. In other matters, the council approved the purchase of a cash receipting sjstem ($10,369) for the Finance Department, nine radios for the Police Department ($16,110) and a suburban-typ- e vehicle for the Fire Department ($9,644). d On West Side Seven Races Set For Primary WEST VALLEY. In addition, Campbell recommended the ordinance include a provision requiring that new homes be inspected by a licensed engineer to certify that the intent of the ordinance -to guarantee the homes can sustain a blast - is met. Long range planner John Janson also noted that Hercules officials also are trying to determine if a berm would cut down the impact of a blast on adjacent homes. - , Elsewhere, Richard McCurdy was granted a conditional use permit to sell Mexican fast food out of a trailer at 6381 W. 2100 South. The policy allows employes to accrue unlimited sick leave time (employes are allowed 13 days per year). Additional provisions are intended to serve as an incentive for employes not to use sick leave, Newman said. Councilman Jay Jackson expressed concern about the unlimited accrual, contending it has the potential to be easily abused. On the other hand, council members pointed out, the city needs to provide for longtime employes who did not use sick leave frequently but who might have a heart attack or require major surgery prior to retirement. Department heads are given authority to verify employes illnesses, the policy states. The proposed policy also gives employes 13 vacation days per year, one more than currently provided. It should be simple, memory added, since you can now do it by mail. Provided you have a clean driving record. And, we happily mused, ours is. So we called the folks at Public Safety to see when wed receive the papers for renewing by mail. Too late, the lady said crisply after obtaining the details. Your papers were sent to your old ad- dress, returned and destroyed. You have to go to the testing center now. In the interest of abbreviating this narrative, well omit the arguments we advanced. Even our research to learn she was right -you are required by law to notify the drivers license division within 10 days after youve changed your address. Weve subsequently talked to dozens of our contemporaries - and found less than knew the law says that. We even suspect the veracity of some of the ls - they nodded knowingly, but had a surprised reaction. We wrote a protesting letter to Larry Lunnen, who heads Public Safety. The gist of our argument was that the determination of ones ability to renew by mail ought to be the driving record, not the home address. He was evidently unconvin ed; our letter went unanswered. Once some of the irritation had worn off, we conceded the only thing to do was visit the drivers license division. Thats a periodic trip we havent escaped in years of residing in Utah. Two other states in which we previously lived were, thankfully, more enlightened - renewing was no problem. 26-pl- In any event, we showed up bright n early for the ordeal. And it is an ordeal when you spend time you cant spare to go through a procedure that shouldn't be necessary. The licensing guys were disarmingly friendly, even though they were deluged by youngsters whod just completed driver education classes and were as eager as small puppies to get their license. Digressing - we always hated tests. All through the educational process, they plagued us. Theres a certain similarity to that old saw, The mind is a remarkable thing. It begins working when youre born and doesnt stop til you stand before an audience to make a speech. So its always been with tests. Faced with a set of questions, our mind melts. Lessee, do you stop 10, 30 or 50 feet from a semaphore? Do you parallel park six or 18 inches from the curb? Must you dim your lights 300 or 500 feet from an oncoming car? How far from one youre following? Do they revoke your license after 100 or 200 points? Who has the right to examine your license if youre involved in an accident? Not so tough, you say? Of course not - unless youre standing, making the appropriate marks. After all, nothing is impossible if you dont have to do it. Finally, convinced its as correct as youre going to get it, you stand with clammy palms while the uniformed inspector checks it. Somehow you conjure up a recollection of being before an immigration official after returning from a foreign land. Theres that same chill silence while your papers are examined and you await the verdict. pen-inhan- Imagine what it must be for an accused defendant as the jury files back into the courtroom Do you understand ! what you he suddenly asks, missed? thrusting the test paper in your direction. You examine it minutely. Looks reasonable - you guessed wrong on those distances. Theres considerable delay while a balky camera is readjusted. Then, after three tries, your photo comes out right side up on the license and the ordeal is over for another four years. Obviously, it wouldnt have happened if wed notified em of our address change. And in the relaxed aftermath of having it behind us, we were reluctantly willing to concede that fact. Nevertheless - the law needs an overhaul. Where you live doesnt determine your driving qualifications. How you drive does. Obviously, the objective is entirely out of focus. -- |
