Right-of-Way Dispute Brings Legal Procedure In a right-of-way dispute, William Reinwald Liechty, his wife Florence, and Ida Louise Liechty, havefiled suit in the Fourth District Court against Howard Hatch, Marjory Hatch, Provo City and Mayor James Ferguson. ‘he lawsuitlists 10 separate causes of action and seeks damagestotaling $185,250. Liechtys state in the complaint that they are ownersof a right-of-way to acres of land belonging to themon Oid Willow Lanein northeast Provo. They charge Hatchs with interference with their use of the 16.5 foot right-of-way by building a porch which infringes on the right of way and by tearing up the surface and destroying it. The complaint charges Hatchs are now constructing a gate which blocks their right of-way. Liechtysalso allege the plaintiffs have trespassed on their property in Evening Glow Subdivision, Lot 46 with trucks and bulldozers, knocking down light post, breaking asphalt, and causing their renters to leave. Liechty also charges Hatch with assault and battery, charging that Hatch broke Leichty’s windshield with a shovel and threatened him. He also charges that Mrs. Hatch struck him with her car, causing him physicalin- jury. _ Leichty charges ProvoCity with failing to enforce its zoning ordinance in requiring Mr. and Mrs. Hatch to have the proper side and back yard requirements, and allowing them to maintain a trailer on a public roadfor living pur- poses. In a final cause of action, Leichtys charge that Provo City has failed to complete extension of Old Willow Road as specified in the master plan. They seek writs of mandamusrequiring ProvoCity to enforce the zoningordinance and complete the road, aNd requiring Mr. and Mrs. Hatch to remove Portions of their house which do not conform to the zoning ordinance. Orem and ProvoPolice Investigating ManyThefts The victim of a recent car theft reported to Orem police this weekend that he foundout he had lost more than the car. AnOrem Police Department report stated that recently Norman Adkin of 915 W. 1200 N. in Orem had his vehicle stolen. The report indicated the car was returned to him the sameday. Over the weekend Adkin told police hehassincenoticed that several items are missing that werein the vehicle. Reported taken from thevehicle are an R.G.
