THE STATE Second District Court judge, who sits in Ogden, made that decision Friday. a week to the day after hearing arguments in the case of the Davis County Library Board vs. Jeanne Layton. Davis County library director, and the Davis County Merit Council. The county agency had argued she was not covered by merit council protection because of her executive position over a large department. The merit council, a lay group of Davis County residents, ruled she was covered and should be returned to her position over the library system. Page represented - the libratv board and said the library and its board are an extension of the county commission. Darwin C. Hansen of Bountiful argued the merit council's position and said the library was set up under state statute with an independent-typ- e board to maintain an impartial library system while Albert J. Colton of Salt Lake City represented Ms. Layton. In pronouncing the decision Judge Hyde, who was called to rule as an impartial judge said. "The library board's authority is not derived from the county commission. but from the Utah State Legislature." , STATE LAW says the county commission "may establish and maintain a public library and for that purpose levy a tax. Upon the establishment of the county public library the commission shall appoint a library board, of five directors, the decision continued, quoting state statutes. Directors shall be appointed for a set term and may be removed for 'misconduct or neglect of duty. Judge Hyde continued. Turning to the role of the library board he said it controls library fund expenditures and said statutes indicate "the board may purchase or lease land, and iease or erect buildings and the board shall be respeonsible for the maintenance and care of the library and establish policies for its operation. there is no support in the cord for the action. re- "IT IS willful and unreasoning action in disregard of the facts and circumstances. A decision is not arbitary and capricious when made honestly and with due consideration; hether or not the court agrees with the decision is immaterial. Judge Hyde said. w The merit council con- ducted a public hearing, heard evidence and argument by attorneys, and after due consideration ruled on a split vote the position of the library director was not an exempt position under the Davis County Merit System and that the director was entitled to full protection as a merit employee. THE DECISION does not appear to be arbitrary and capricious but was made honestly and carefully and has a basis in fact and in the evidence received and is consistent with Utah law governing libraries. He continued. "At the hearing of January, 1980. the council further ruled the library board had failed to show the dismissal of the director was for cause. At oral argument, plaintiffs abandoned their request to review the actions of the council of Jan. 10. 1980 and agreed their decision was reasonable." IN MAKING his ruling he concluded. "Therefore.
