Show Residents May Sue Fruit Heights City Page 44, Lakeside Reiew, October 30, 1980 FRUIT HEIGHTS Citizens in Fruit Heights are preparing legal action against the city because they have been turned down in an attempt to hold a referendum vote, on a zoning law. The citizens requested the referendum because they disagreed with a decision the city council had made concerning a zoning change on June 3 of this year. Marilee Wilson, a citizen representative, said, We are asking for the right to have the referendum vote. We feel that Utah needs the right for citizens to vote on something that major. Assistant City Manager T.J. Burns said that if the city had a master plan developed and approved at the time of the zoning change there would be no referendum vote allowed. The city is approximately two months away from final approval of its master plan, he said. The property involved in the action is located at the southwest corner of U.S. 89 and 4th North and involves approximately 8 acres. On June 3 the city council approved a zone change from residential to commercial usage. This is what upset the citizens, Mrs. Wilson said. They dont want a commercial area by their homes. Their attorney,' Curtis Drake of Salt Lake City, was unavailable for comment on the case. Mrs. Wilson said she believes he is getting ready to file suit. Manager Burns said this action could have some serious consequences on the city of Fruit Heights. At a recent planning commission meeting it was mentioned that they may have to begin considering disincorporation and annexation to another city. Burns approached the commission with the suggestion that a meeting between Kaysville and Fruit Heights planned for the first part of November may be a good time to bring up the idea of a merger with them.
