KAYSVILLE The Kaysville Chamber of Commerce heard Davis County Attorney Rodney Page discuss how to protect estates from inheritance tax, last week. , Many tax advantages are available that many people are not aware of, he said. When provisions are not made before a person's death, the estate can be taxed, he said. Estates can avoid probate court if a will is drawn or the estate is put into a trust. Trusts come in two forms revocable and irrevocable, he said. An estate is subject to inheritance tax when its value exceeds $180,000. A marriage exemption allows the spouses survivor to retain up to $500,000 of the estate before it is taxed. If a will is drawn up, the estate will probably avoid probate court. A will drawn up by an individual is called a holograph will. It is. drawn in the persons own handwriting and then signed. When neither husband nor wife survive to claim the estate and no will is drawn on it, the estate will probably wind up in probate court, he said. In probate court, the courts help decide what the survivors will get. A will would help an estate avoid probate court. So would a trust, Page said. ' He said a gift of up to $100,000 can be given to a spouse before death. If that is done, the money cant be taxed. , and-Webe- PERM SPECIAL OFF Experienced .
