MAYBE SO, and perhaps things could, and should be different. But first, lets take a look at what transpires in Justice of the peace, Circuit Court or District Court of Davis County. Let's take a case of a motorist who is cited by the Utah Highway Patrol for traveling 70 miles per hour on Interstate Highway 15. THE MOTORIST is given a traffic tic ket for the offense and told that he must sign the ticket as a promise to appear in court within 14 days, or sooner if designated as such on the citation. A copy of the citation is submitted to the nearest justice of the peace or circuit court. IF AFTER the designated time, the motorist has not appeared to enter a plea or to pay the fine, a letter is sent by the court to the address as listed on the citation. If the letter is returned as an "unknown address," the court will attempt to find an address by other means, even to the extent of searching their own court records for a more recent address of the offender. COURTS WITHIN Davis County have also emphasized that they will often attempt to reach a person who has failed to appear on a misdemeanor charge by telephone and tell him of the seriousness of not appearing for a court date. "By failure to appeur as designated on the citation constitutes still another misdemeanor offense," said 4th Circuit Judge S. Mark Johnson, Some persons just dont realize how serious it is to neglect a court appearance as promised or the consequences of being served a warrant for arrest. JUDGE JOHNSON emphasized that there ts no state statute that requires court personnel to send letters or telephone somwne who is about to be served a warrant lor arrest on a misdemeanor charge. Is it the person who receives a citation and refuses to pay, or is it the person, like most, who shells out the money and suffers the consequences of having the points applied to his driving record? Why should the latter suffer while the first person attempts to go free? HE ADDED that eventually, most of the offenders are caught But its too bad that it takes a warrant of arrest to bring them in. The local court system, as harsh as it may seem regarding warrants, nevertheless bends over backwards to aid the alleged offender. Persons are given every opportunity to make restitution for the offense of which they are charged. BUT THERE still may be other ways, better ways, of making arrests and treating the suspected traffic offender.
