TESTS, REQUIRING FEASIBILITY STATEMENTS ON SUB- DIVISIONS DIVIDUAL USING Subdivision means the division of a tract, or lot or parcel of land into three or more lots, plats, a. sites, or division of land for the purpose, whether immediate or future of sale or of building development; provided, that this definition shall not include a bona fide division or partition of agricultural land for agricultural purposes or of commercial, manufacturing or industrial land for commercial, manufacturing or industrial purposes. A subdivider is an individual, corporation, or registered partnership, owning any tract, lot, or parcel of land to be subdivided; a group of two or more persons owning any tract, lot, or parcel of land to be subdivided who have given their power of attorney to one of their group or to another individual to act representing, or executing the purposes of the sub- division. c. Development Area. Development Area is a proposed subdivision, a tract, or a parceling of real estate where houses or in- tended to be constructed requiring the use of individual wastewater disfor posal systems wastewater disposal. Section 2. PERCOLATION TESTS a. Percolation tests shall be performed in accordance with Section a. to g. inclusive, of the Utah State Division of Health Code of Waste Disposal Regulations Part IV, as adopted by reference IV-2- herein. b. Percolation tests shall be performed andor certified by either a Registered Sanitarian, currently registered to practice in the State of Utah, or by a professional Engineer, currently registered to practice in the State of Utah. c. Percolation test results must be recorded on forms approved supplied by the Davis County Health Depart- ment, Environmental Health Division. d. An adequate number of percolation tests must be performed to show variations in true soil conditions throughout a development area. IN- WASTEWATER DISPOSAL SYSTEMS, ADOPTING THE UTAH STATE CODE OF WASTE DISPOSAL REGULATIONS, PARTS I, III, AND IV BY REFERENCE, DEFINING ion-sit- A minimum of one percolation test per acre must be performed except where fewer tests (minimum of 3 tests7 acres) show test results that do not vary more than five minutes per inch from one another across the development e. Percolation tests must be performed as closely as possible to the areas on the lots or parcels in the development area where absorption systems are to be constructed. Section 4. PERMITS AND FEE SCHEDULE a. When percolation tests are run and certified by the Davis County Health Department, Environmental Health Division, a fee of $30 per test hole will be charged. If over five, but less than ten, percolation tests are run in a development area by Davis County Health Department, EnHealth vironmental Division, the fee is $25 per test hole. Where more than ten test holes are run in a development area by Davis County Health Depart Section 52, Utah Code Annotated, 1953, as amended. It is the order of the Davis County Board of Health that these Regulations become effective 15 days following the date of their publication. (2) Additional inspections will require an additional $5 fee per onsite visit. c. A fee of $15 will be transportation expenses at the rate of seven cents a mile for the use of your own car. That will reimburse you for those trips to the doctors and dentists offices, to the hospital or clinic for treatment, and the trips to and from the drug store to get those prescriptions. If you have not yet started or contributed to an Individual Retirement Account (IRA) for which you were eligible in 1978, you can still do so until the day you mail your return. Dont cheat yourself on your sales tax deduction. The allowable sales tax chart in your book of tax forms from IRS contains some footnotes which could create a bigger deduction for you. First, add to your taxable income other items of nontaxable income (such as Social Security, unemployment compensation, Veterans Administration and Railroad Retirement Act benefits, your dividend exclusion and the untaxed portion of your capital gains). Now, with a higher total of spendable income check that sales tax chart to determine your allowance. The energy credit is new this year and could be overlooked, even though it could reduce your federal income tax by as much as $300. The credit is 15? of your outlays (but you cant consider more than $2,000 in expenses) for insulation, storm windows and doors, weather stripping, caulking and the installation of energy-savinthermostatic controls in your home. Should you be reporting any longterm gains on your federal tax return, remember that only 40 of the gain is taxable on any transaction occuring November 1 or after in 1978.
