He spoke to them immediately after they had heard from the representative from the brokerage firm handling the plants insurance. David Smith of Johnson and Higgins, the brokerage firm through whick Katy Seghers, Inc. is getting liability insurance for the plant, came to answer questions for the board. He told the board that Johnson and Higgins is the largest privately held insurance firm in the United States and one of the three largest firms in the world. When the board members questioned the high rates they are paying he told them that they are caught in the worst insurance time in the last 40 years. Insurance pricing goes in a cycle and insurance is in the costlv phase right now. Before 1984, insurance companies could get good interest returns so the premiums could be less. Liability awards also started going up in 1984. In addition, the reinsurance market which is centered around the London market opted to stay out of the United States market. Another factor was that the companies discovered that they could charge more and so they did. Smith also told the Board that he felt the market is stabilizing and has topped out and rates will slowly start back down somewhat. The total insurance package for the plant is projected to cost $900,000 per year. However, it is possible that it could cost more. The board would have 30 days advance notice. Board members asked why they are not seeing any documents or paperwork if the insurance is going to cost so much. Smith told them his firm has approached 30 or 40 insurance companies. The perception of the exposure to risk does influence the cost. Shopping around might make insurance companies less willing to insure the plant also. Mayor Robert Arbuckle of Farmington asked, Cant we get a look at the insurance before we pay for it? I doubt it, Smith replied. He explained that big companies dont do it that way. The board decided to put together another list of questions, look at other insurance companies and not to pay for insurance until they have more answers. According to the contract, Katy Seghers Inc. will arrange for the insurance but must get approval from the board which they have not done yet. In addition the board will like to take back the responsibility for the insurance so they can have more control of the matter. Next, Senator Haven Barlow Insurance in Layton addressed the board. He told them that the district probably falls under the procurement act of the State of Utah and they may need legally to go through the state for insurance. He also told them that it is impossible for any one broker to have access to all insurance companies. He also told them to not worry about upsetting the market by shopping around for a good price. Senator Barlow also told the board that while the United States is the worst for insurance premiums, states that have enacted major insurance reforms will have better rates. Also political subdivisions have benefit of immunity because of new laws. Senator Barlow said that he was really disturbed at how the insurance was being handled. As the cost of the insurahee is being passed on to the public, a government entity has to be involved in evaluating the insurance. He also told the board that his company has been denied access for an insurance inspection 10 days ago at the plant. The insurance issue was left unresolved. County Attorney Jerry Hess said that they should attempt to get the insurance back into the districts hands. Wil Jefferies said that part of the problem may be that it is Katy Seghers that is being insured. In the meantime, Jim Young will work to get Barlow insurance access to the plant as they felt that even if they could not accept a bid from that company at this point, the public should know the difference in prices.
