Show Top of Utah 4B Tuesday May 18 1999 Suit From IB continued the assault and used unlawful excessive force to detain her according to the suit Johnson said she was taken to McKay-De- e pital for a concussion a broken nose and a sprained shoulder before being booked into the Weber County Jail “As a proximate result of the defendant’s actions plaintiff has sustained permanent injuries and disability” the suit states A police report filed by Gent says she was only treated for a bump to her forehead Johnson was later charged with robbery a second-degre- e felony assault on a police officer a class-misdemeanor and simple assault a class-misdemeanor A trial on the criminal charges is still pending in 2nd District Court “I’m not a bad person” Johnson said “I know what I did was wrong and I apologize for it” But she added “They don’t have a right to beat you up and break your bones - that’s why we have jail or fines” Johnson said her primary motive for the suit is not for the money but to remove Gent from the street To substantiate her suit Johnson said she will attempt to obtain a copy of the store security videotape which she claims recorded the assault Gent has declined comment on the case Assistant Ogden Police Chief Marlin Balls speaking for the department said he does not believe Johnson’s allegations Albertson's Corp spokesman Mike Reed declined to comment on the suit “We have been A B Police From IB which a small amount of marijuana was found in his possession Tehero said the officer demanded to know who supplied him the marijuana and became angry when he wouldn’t talk Tehero’s cousin Richard Tehero also told the Standard-Examinhe witnessed the assault The officer states in his report that he hit Steven Tehero twice in the head but only because the boy was attempting to knock him down to the ground Day said whether or not the allegations turn out to be true the cases highlight the need for a police department citizen review board “We have citizen oversight in about every city department except public safety” he said The review board would be responsible for helping craft public policy and listening to citizen complaints against the department he said Like Day city council chair er SL man guilty in back-yar- d served with a notice we’re reviewing it and we’re determining what action would be appropriate to take” Reed said A letter to the Standard-Examinby Ogden City Attorney Norm Ashton states “Ogden City will not comment with specific responses to the allegations because its belief that all relevant facts will be brought out in court and cases should not be tried in the press Nonetheless we have reviewed witness statements and police reports and made a preliminary determination that (the claim has no merit)” He goes on to state: “The chances of the officer bystander or suspect being injured substantially increase when individuals take it upon themselves to use force to resist arrest The appropriate time for any person to challenge then- arrest is in court not on the street attempting to fight with armed police officers” In his probable cause affidavit Gent gives a very different account of the arrest than Johnson gives: “When the employees tried to stop Johnson she started to resist” Gent stated “When they tried to hold her she started to throw punches (at) an employee breaking his glasses When I arrived employees were trying to restrain Johnson but she continued to fight When I tried to cuff Johnson as she was leaned over the trunk of a car she kicked backwards striking me in the lower left leg I put Johnson on the ground and cuffed her as she tried to fight with me” Gent quotes two witnesses in his report who say they saw the arrest and that store employees handled the situation calmly until Johnson and her daughter began to fight with them One of those witnesses Paul Williams 74 told there was no excessive force the Standard-Examinon the part of the employees or Gent “I saw nothing like that” he said 9 You can reach reporter Ryan Oliver at or him at rohveria standard net Prosecutors said Butterfield rape sneaked into the girls’ back yard in South Salt Lake on May 17 slit open a tent attacked two girls and then broke into the house to molest a third girl sleeping on a sofa sleep-ov- er The Associated Press er -
