following was wag read by the recorder E 0 stanton city recorder dear sir I 1 hereby return disapproved ordinance no entitled an ordinance for the construction and maintenance of street mama mains and services for utilizing and distributing natural and manufactured fuel gas in the city of salt lake passed by the city council july ath 1892 for the following reasons first the new american gas fuel coits boits successors and assign sare granted the right and privilege of using any and all 11 streets avenues and alleys of the city in in which to lay and maintain mains and service pipes the only restrictions placed upon this sweeping grant are in the foll fol lowing proviso to wit that all streets avenues and alleys shall be speedily repaired andrut and put in as good condition as they were before the excavations were made that not more than one main pipe shall be laid in any one street without the express consent of the city council and that in the construction maintenance and 0 operation n of said mains and service pipes pipe t the h said i d grantee rantee and its successors and assigns shail shall at all times conform to such auch ordinances rules and regulations as may hereafter be adopted by the city council in relation thereto py in my opinion the general grant quoted to is not sufficiently limited by these proviso if but one pipe be laid in each street it follows from the grant itself that the company would have the right light to lay service mains across the street wherever it chooses some of the streets are already paved with asphaltum others will soon be and within twenty years gra granted anted in the proposed charter charier the streets in most parts of the city will be paved it is impossible to make th these ego pavements met m et by repairs when out through ty by trench anything thing like as good as they were before therefore in place of requiring only one pipe to be lai laid in each street a pipe on each side of the street should be requiem when the gas is used on both sides aides and the company prohibited from crossing the streets by service mains except by of the council the he c city t ty has haa already expensive systems of water and sewer pipes these gy systems stems must moat in the near future be greatly extended for this reason should be so limited as to prevent any interference with these systems or their future extension this can be easily done by reserving to the city the right to require the company to change the locations of its pipes and mains as necessity may require aire and the right to designate the location tion of the pipes and mains in the tb first instance second As it is very difficult to prevent the escape of natural gas and as fatal accidents are liable to occur in case of its escape the right of inspection ion ought to be reserved to the city with authority to require the company to make such repairs as it may find necessary and adopt such mich appliances as experience has or may hereafter point out as a conducive to safety in the use of gas third the maximum price 30 cents pe per r 1000 cubic feet which the company m may y charge consumers at present I 1 do not think exorbitant considering onside ring the great cost and hazard of tho the proposed enterprise rise nor do I 1 believe it will be ex ef exorbitant Eor hor bitant tor for several years yeara to come but it may become so before the expiration n of the charter the city is rapidly increasing in population and business and the co consumption of gas must correspondingly increase and as it increases the profits of the enterprise must also increase an and d while I 1 recognize the fact that a practical use of the na ural gas discovered by the energy and enterprise of the prin principal apai promoters odthe of the proposed company is of great value to the conk community and the parties who have developed this important element should be granted liberal opportunity port unity to enjoy its if fruits yet if in the future the profits should reach a point as to render the price fixed exorbitant the city should have power to reduce the price to a reasonable amount I 1 therefore recommend the insertion of a clause allowing the city council after the lape of say three or four years to fix the price within the limit between thirty cents and some reits reasonable sum less leis than thirty cents B R N BASKIN mayor lawson these points are all fully covered they were thoroughly discussed before the passage of the ordinance and the mayors recommendations are therefore unnecessary and I 1 now move that the of the four members of the council and the testimony upon which said report was made beg leave leave to report as follows after a careful examination of the testimony and after hearing the swe ments of the gentlemen in que question alon we believe that they were actuated by a proper motive in visiting the houses mentioned their purpose being to in 1 vesti gate certain statements made to them which they found to be true the committee commit teA on police were given the facts by these 4 councilmen but the action of the mayor relieved that committee of further investigation therefore we ewing offered the following minority report and asked that it be adopted in lieu of the majority report asa As a member of your committee ap poin ed to investigate the action of certain councilmen as set forth in the communication of the hon mayor to the city council on the ath day of july 1892 1 I beg leave to submit the following minute report touching kaid haid matter ic 16 appears that the members of the said council referred to in the communication of said mayor went upon the evening in question stion at their own sollon soli and on their own responsibility sivility lity and were not upon auy any official but business sines authorized by the body to which they belong it also appears hom the testimony before the committee that said councilmen on the evening and occasion in question were engaged in in investigating ing the conduct of certain officials aud and employed emp loyes of the city this investigation was entirely unofficial and not called for by the council it is therefore my opinion under the circumstances that thi this IS body has no authority to take any action in the premises holes rising quickly I 1 move we the adoption of the minority minu mi aulty aunty rity report bell I 1 second the motion moran I 1 move to amend by adopting the majority report lawson promptly I 1 second the amendment bell I 1 claim that the th Co council has ho jurisdiction over its members after they leave this chamber their aoto act are chuse of private citizens and this body has no power in the premised premise I 1 shall therefore vote aute against the majority report circumstances tb strict u rue of the mayor mayo ing I 1 have no apologies to offer for my conduct that night I 1 did no nothing but what I 1 am willing and the public should know I 1 have beba
