plaintiff comes and complains of the above named defendants defendant and for cause of action alleges first that this plaintiff is now aad has been ever since about the ata ath day of may A D 1888 a duly qualified and appointed member of the territorial territory fal democratic central committee of this territory Terri ory this plain plaintiff wib divers other persons persona in utah Territory having been on or about the day tt last aforesaid appointed as such committee by that certain political association of pert ons citizens of the united states of america and electors of and in the Teril territory tory of utah known as the democratic party of utah territory by their duly duly authorized and accredited accredit 2 agents and representatives in convention assembled for the term and period of four years from the date last aforesaid and ano until their successors should be in like manner duly appointed second that said Demo democratic crade party of utah territory has been organized and has existed in said utah territory since about the year 1872 third that on or before this second day of april A D 1892 this plaintiff was by the order and resolution of said committee duly made constituted and appointed po anted the secretary of said committee and as such secretary this plaintiff by the resolution and order of said committee duly made was and is charged with the proper and safe keeping and custody of all the record books minute books and books of account and papers pertaining to the office and proceedings or of said committee and was placed in possession of the same except those books and documents hereinafter described as being wrongfully withheld from his poss possession eslon by y the defendants to wit two certain books of record containing the proceedings of meetings of the democratic territorial commit commatee comm itee ee of utah territory since the year 1887 fourth that chaton on the ath dakof day of may A D 1892 at salt lake city utah territory this plaintiff was as aforesaid the agent entitled to the he custody and actual and immediate possession of the following described books of record a and nd documents of the value of fifteen dollars to wit those two certain books of record containing the proceedings of the meetings of the democratic territorial committee of utah since the year 1887 fifth that the said defendants on the day last aforesaid did and do now without the coment cement of plaintiff wrongfully withhold and detain said books and documents from the possession of plaintiff sixth that before the commencement of this action to wit on the ath day of may A D 1892 the plaintiff demanded of the defendants the possession of said books and documents notwithstanding which demand and the premises the said defendants still unlawfully and wrongfully wrong lully withhold and detain said books and documents irom from the posses sion of plaintiff to his damage wherefore the premises considered plaintiff demands
