Show agricultural COLLEGE DISPUTE THE difficulty between the trustees of the agricultural college and the board of construction appointed under the utah statute of 1892 will in all probability be settled soon in the courts the money appropriated by the legislative assembly for the agricultural college building is not at present available because the territorial auditor refuses refugee to issue warrants for the money until e knows who is legally entitled to receive them inthis we presume he is perfectly justified for the laws relating to the matter need the construction of a competent court and leave him in doubt as to his duty the appointment of the board of co construction st under the act of 1892 would be all right enough if it were not for the provisions of the act of 1888 the legislature had power no dodot to provide who should expend the money it appropriated to extend the facilities of the agricultural college and to supervise the erection of the additional buildings ull diDgs required although this is involved in prin principle cille in the dispute that occurred over the worlds fair appropriation yet it was waived by the governor for reasons that have been fully explained explain eti but the act of 1888 establishing the agricultural agriculture a I 1 college and providing for a board of trustees for its management gave them power to control the lands belonging to the institution and supervision of the erection of college buildings and to make all purchases and contracts and if these provisions are in force then it appears there are two seto set of officers charged with the performance of the same duties or else elee the later appointments are void the question is ie whether the provision in regard to the duties of the trustees is repealed or whether it is suspended by the later provision and the board of construction can act us as having the expenditure of the present appropriation only or whether the later appoint appointments mento are invalid entirely in view of the act of 0 1888 only a competent court can officially cally deride decide these questions and we understand the board of trustees will bring suit before judge zane to compel the auditor to issue the necessary warrants to that body this will bring the question up squarely and the public will await with interest the judicial settlement of this dispute |
