until the specifications were prepared as a contract implied specifications thus enlightened mr pembroke subsided the city attorney rendered a report on the petition of james W eardley who desired to pun purchase hase from the city its title to a certain piece of land forming a part of a lot petitioner had bad purchased from another party supposing he wa was i obtaining a title to the whole of the lot the report was adverse to the petition and was adopted the recorder reported that certain notices of water main extensions had been duly published and the assessment was confirmed the city engineer submitted a profile si showing s lowing owing the gride of west street referred to committee on streets the same officer in a report advised that means be at once adopted to irrigate the shade trees on south temple street where it is being improved and that suitable pipes be laid across the sidewalk before it is paved to conduct water to gardens the matter was referred to the committee on ip irrigation with power to at a t in regard to irrigating the trees and 0 o report repart in regard to the pipes under the sidewalk pavement the same officer reported on the tunnel in city creek canyon made by J ff H snell showing a balance of 36 still due on the job the city engineer also reported as follows As to petition of E A folland and others regarding the tracks of the union pacific and the rio bio grande western on west brigham street be tweed fourth and sixth west streets the street is almost impassable in places in consequence of the excavation made necessary by the change in g gauge a u and position po of the westerns We sterns tr track a ct to provide proper clearance between trains this track has been thrown several feet north of its original position and the street is made correspondingly narrower at one place a set of switch ties have been placed with a view to constructing an additional sidetrack or spur and the ends extend so far beyond the rails as to leave at this point only about ten feet in width of available street the obstruction of the street is made more complete by the use of those these tracks for storage and general yard purposes for relief of petitioners petition ers I 1 recommend 1 that all cars be removed from the street at once and be hereafter prohibited from standing in the street 0 2 phat mat the respective companies be required to grade and level the street out to the curb lines on od each side aide and to provide good plank crossings opposite their respective gateways public interests will be best served by the removal of all except one track along tho th centre of the street to be used jointly by the two companies or perhaps a ifer aber and equally as satisfactory a plan will be to rearrange the track so that the union pacific would occupy a position on n the south and the rio grande western a position on the north side of the centre of the street this would leave an equal width of roadway on each side of the street instead of practically occupying the entire north side as at present the reading of this report gave rise to a warm d discussion after a motion to adopt it had prevailed mr pembroke said mr president it seems to me ale that we ought to do something besides merely adopting the report I 1 am iu favor of having this matter referred to some officer with instructions to carry out the suggestions of the report anil and compel the railroad i to come within the law mr cohn expressed a similar view the mayor suggested that the report recommended alternative measures and inquired what mr pembroke would like to have done the city attorney suggested that as a measure of immediate and temporary relief the city marshal might be inspru ted to cause all cars to be removed from the street and to use all necessary force to accomplish that object that next legal proceedings might be taken to compel the railway companies to grade the streets in accordance with their contracts with the city and remove tracks laid without right mr pembroke mr president I 1 heartily endorse the suggestions suggestion of the city attorney and adopt them as my motion mr 1 I move to amend by including fourth west street north of north temple A great many cars are allowed to stand on that street and it is very much obstructed with side tracks and switches causing much complaint pla n t the amendment was agreed to and mr Pem brokes motion was adopted chief stanton of the fire department in a report stated that recently over fifty business men had complained io to him of the danger of fires being started in the rear of stores in the business centre he recommended the creation of a fire inspector with suitable powers referred to th committee on municipal laws mr rall hall it seems to me the police should look after this matter the mayor we have investigated the matter and find that the police have dot the power I 1 assessor clute reported on sidewalk district no 2 city Atto attorney ruey merritt stated that assessment lists should be referred to a board aboard of equalization and review to consist of five members to he be nominated fy y the mayor mid and accepted by the council he explained the law upon the subject and a motion was adopted that the mayor nominate the mom members bers of the board the mayor said he would present the names name later sater the committee on streets reported on the petition of the west side rapid transit company for permission to use steam as a motive power setting forth that the company had expected to use gas but the invention had proven a failure and recommended that they be permitted to use steam dummies the fhe report stated that there was no known opposition to this from property owners and recommended that the council reserve the right to revoke permission to use steam on six months notice the report was adopted and a bill for a resolution amending the franchise in n acco accordance rd I 1 therewith was passed the committee on OH waterworks water works reported on a number of minor mattery matters that had been referred to them and recommended the laying of a four inch main on each side of ane culvert on OB north temple street which was ordered done the committee also recommended the extension of the water mains down second south street to fifth west and that property owners who so desired might tap it on 1 p of the four mill tax adopted L phe he on streets reported adversely on the petition of a mr burton anti and others relative to building a retaining wall in a certain street that was being improved and thought the city ought not to do such work in ordinary cases adopted rhe fhe same committee reported favorably on the petition ot of harrington newell about a subdivision they desired to be accepted adopted the same committee reported favorably on forms for bids for street work which had been prepared by the city engineer adopted several retail liquor licenses were granted the expert water commission reported the completion of another artesian well near liberty park mr john cohn said that that part of west temple street lying outside the sprinkling district out to be sprinkled as it was a favorite drive and very dusty his motion to appropriate prop for the purpose prevailed the city attorney stated that his hie deputy mr Elch eichnor nor who conducted prosecutions in the police court was the poorest paid officer of the city in proportion to the services rendered as he received only 75 per month and gave his whole time to the business of the police court mr merritt introduced a bill for an ordinance making we salary of his deputy pet pel mouth month the bill passed mr pembroke called attention to the fact that some months ago the R U G W railway corn com any asked the use of sixth west street from second to fourth south the speaker wrote the committees committee report on the petition recommending that it be granted but by a mistake ke made the t ranch tse read one block instead of two he moved that the correction tie he made mr merritt I 1 think we should grant no more favors to that load until we find out which is the greater it ii or this council mr pembroke 1 I do not see what that has to do with this matter mr merritt should this council radt favors to a corporation which treats it and its ordinances with contempt mr pembroke yes hut but a mis take was made in report and I 1 thing thine it should be corrected mr merritt that is we should give the road another block of street to use after its bontem violation of the terms upon which former franchises have been gr anted to it mr pembroke 1 I dont see that that has anything to do with the mitter matter at all This Council Counell intended to give two blocks of streets to the railroad rai road and I 1 think this should be e done the railroad promises to grade the th streets mr merritt Menil fc yes it promises but does it ever fulfill has it come before this council as a humble suppliant for favors has it not rather assumed to be ni m ster of the city has it not dered the law has it not nol blocked the streets outraged outrage the rights of citizens and utterly disregarded all its promises and contracts to improve the streets let this corporation po ration meet its obligations come within the law and treat the government and ordinances ot of this city with proper respect until it does this I 1 think this council should grant gra ut it no more favors mr pembroke per pers istel in urging that the additional block of street should be given to the railroad the mayor suggested that he move to recall the committee report for amendment he so s moved and his motion carried A communication from J W mcnutt city recorder of ogden was read inviting the council in a body to visit that eaty the invitation was accepted and this morning fixed as ane time of departure the ordinance creating sprinkling district no 2 with boundaries as described describe above
