this agreement made in duplicate this day of june A D 1890 between salt lake city a municipal corporation of the territory of utah and salt lake county of the territory of utah the parties of the first part and 0 E ap apponyi of said city and county of salt sal t me lake the party of t the he second part Wit that the said 0 E apponyi for the consideration hereinafter mentioned promises and agrees to and with th the party arty of the first part and that he wilf will promptly make and use the utmost care in prepa preparing I 1 ng full fuh and perfect plans and specifications necessary or needful for the erection and completion of the joint city hall and county court house building to be erected in said city and for said city and county and that the said second party will execute a bond in the penal sum of five thousand dollars to said first parties for the faithful performance of this agreement and guaranteeing and saving iving s sald said first parties harmless from any loss lose damage or injury sustained by said first parties in the erection and construction of said building by reason of any mistake or imperfection in the plans or specifications of said second party and that he will make good any and and all damages or injuries affecting said building or sustained by reason of or growing out of such mistake or imperfection as aforesaid and that the said C E apponyi shall have the absolute control of the construction and supervision of said building until relieved as herein provided and that he will use the utmost carev care diligence and skill and faithfully superintending super intending the construction of said aid building for the consideration and subject to the conditions hereinafter named and the said first parties in consideration of the premises agrees to pay said apponyi for his plaus plans and specifications ficat ions three and one half 3 per cent of the cost of said building and for the construction of said building one and one half la 11 1 percent per cent of the cost of said building said payments to be made in case said C E apponyi superintends super intends the construction st of saidi building as well as furnishes 3 a said plans and specifications i in n the following manner to wit i twenty five hundred dollars upon executing this agreement and the bond heretofore mentioned and in four months from the date hereof in twelve months from the date hereof and the balance on completion of said building provided that if the said first parties should deem it necessary or for their best interests to release said C E apponyi from the aforesaid at t any time they may do so and are hereby expressly given tho the right in their discretion so to do u upon p on the payment of said three and one half 3 per cent for the plans and at present stating them or the gloudis on which they are presumed to be based we will here introduce a report on the plans an and d specifications from mr fred A hale architect to whom they were referred for criticism mr MB HALES FINDINGS to the building committee of the salt lake city and county buildings emen in compliance with your orders I 1 have examined tte the drawings and specifications for the caland any and county bull building dine and beg to submit the follow following ln re report ort we wg will I 1 grat first take up the question of strength and the durability of the building the brick walls of the central portion of the building are three leet feet thick the entire height which is bad construction I 1 have assumed that the tower proper is to be omitted thi th weight on each square of basement tower walls wall a with tower omitted emitted is 8 4 to tons no with the material and workmanship liable to be obtained in this city I 1 consider sixton six ton pressure our p per r square foot the limit of safety in short even if via the tower be admitted the basement walls would crack and soon become dangerous it if the tower should be built the basement waits would undoubtedly crush take again one of the inside columns 8 inches in diameter one metal a basement abasement column said Saide column olumn will safely carry 65 tons but the load thereon according to plan plan is 77 tons aud and the column is unsafe ansaf e k the he footing of brick under said column 1 is 3 nine re feet hence the pressure on th the e brick is in tons per square loot foot but as six tons per square foot is the limit of safety the brick work would certainly crack ana and eventually crush the thickness of the walls in most cases is not figured on plans hence it has been difficult to aso ascertain ertain their a bength the corner turrets appear to be built of stone but no support is provided for the inside corner I 1 cannot ascertain the he kind of material used in constricting the roof of said aid turrets the beams under gallery posts are not of sufficient strength they should be capable bleff of earr carrying ying thirty two and one half tons but as specified their limit to is thirteen tons or seventeen tons ions as shown on one drawing the drawings disagree di disagree rhe necessary tie rods between beams have been omitted on oa gallery plan of steel work I 1 also object to eight inch walls three or four stories high with steel beams of chent strength built therein the beam hould be strong enough t carry the entire strength THE DRAWINGS the drawings and specifications are a part of the contract in fact the very essence thereof hence should he exhaustive and clean and free fro 11 errors thus saving large bills of extras I 1 find the drabin drawings a and specifications very incomplete fu in some cases the kind of material to be used cannot be ascertained and in other cases a variety of material ii indicated for the same purpose the rhe window areas are not shown on the plans lane their size and material must be con lectured letu red the flues are located wrong on basement plan all elevator walls are dx except at fifth th floor which is ax error ahe 1 he section of the water closet should show in section of building error one iron de tail of sky light webs does not tally with on section of building also the figure in drawn no acce a is shown to the roof or to the rear area no transit is indicated over inside doors no doors are shown to the water closets the great variety of windows part of them practically inaccessible showing the court rooms and council woula present from the interior a very unsightly ap bearance pe arance the gallery floor should be inclined inc med LACK OF DETAIL there are no drawings whatever wh etever of at the window frames or the door frames of the finish casings etc chere are no details of the stone work the statue is not mentioned and might be furnished ot or marble or zinc at the option of the contractor i he cepi delih it of air ducts location of sewer etc to which reference is made to plans is not indicated on plans the figures on drawings are very incomplete in short there are not one third enough drawings to illustrate the building ina in a proper in inner so as to allow an intelligent tell igent estimate of cost and to insure a conti 11 ta act embracing did not muse cause the committee to decide in his fall favor vor it appeared to be necessary to find some competent judge on such subjects who would criticise criticism critic ise the plans and in intelligently while it to is impossible to tell in most cases precisely what may or may not be intended I 1 should fear if an attempt were made to erect the walls from these plans that they would not
