engaged the name of the man killed is joseph about 22 years rf cf age he was engaged as a sheepherder by mr bergen demott who lives near gilmers Gil mors the latter says that he did the shooting in self defense monday dec 23 gilmor was it with his shotgun he says he was out hu hunting ng rabbits mr de young son was out with some of his fathers sheep and thy went on to gilmers Gil mors farm the latter had his little girl with him and proceeded eded to drive the sheet sheep to his corral the boy demott and nd his dog tried to prevent this but gilmor shot at the dog and the boy ran rail home shortly afterward joseph came from mr demotts residence armed with a Will winchester chester rifle gilmor says that when about forty rods away fired at him the bullet passing between him and his little girl that when came up close he gilmor asked why the shot bad been fired aud and that raised his ri fleat which gilmor took aim and fired the charge taking effect in Wal keys breast killing him instantly the deceased was known as a quiet young man and his friends do not believe Gilm Gil mois oils account of the affair another account says that the two shots were fired almost simul the only wit witnesses are mr gilmor and family and their statement is substantially as first given after the shooting t gilmor came to town and consulted consult d with an attorney after which lie he gave for 10 december 24 before U 8 S commissioner greenman but up to that hour the prosecuting attorney had received no information of the case and the hearing bearing was postponed till a later hour it was then taken up and after hearing mrs gilmers Gil mors statement bail was fixed at and tire the examination continued till friday december an inquest was held before the V precinct justice of the peace wm langford dec the first witness was mrs sarah gilmor wife of varies charles gilmor she tied ed that deceased fired two shots before gilmor fired at him at the time lime 11 ired fired the shots mile east of gilmers Gil mors house heard the first shot fired and about two minutes later heard another shot and the yel yelp of a dog as if it had been shot heard aweard only two shots would have heard more if more had hd been fired stephen hansen testified was half a mile from the sheep heard two shots and soon after saw the come over the hill three or four persons were driving them I 1 then saw leaving de mottle motta and going towards gilmers Gil mors hau house when within one fourth of a mile of gilmor he fired one shot could not tell in w hat direction then went on towards gilmers Gilmor Gil mors 8 house when was nearly to the house witness heard another shot and looking up saw a man hoot at a dog saw the dog run a short distance and lie down dowd witness supposed that the shot in the north point precinct of salt lake city on the twenty fourth day of december Decem A D 1889 before wm E langford justice of the peace upon the body of joseph walk ey there re lying dead by the jurors whose names are hereunto subscribed bed the said jurors on their oaths do say from the evidence presented that he died near the residence of charles gilmor at north point in salt lake county U T between the hours of 8 and 9 a in december 1 A D 1889 from the effects of a gunshot wound inflicted by a weapon in the hands of one charles gilmor said jurors also find from the evidence received two years was present last monday when he wao wae killed it was as between 9 and 10 iu in the morning the shooting took place at the west side of our house which is at north point within the limits of this city I 1 got up firsti first and after awhile my husband went out to dig a rabbit out of a hole where it had gone the night before my husband had bad a gun he came back about half past 9 driving some sheep my son was with him they had seven or eight hundred bundred sheep the flock had been grazing on our land my husband and boy brought them home and put them in the enclosure joseph came up while they were bringing the thes sheep beep I 1 first saw him about a quarter of a mile away when he was about yards from the sheep he fired at me and my smallest wy toy I 1 was then helping to drive i the sheep sheep I 1 heard 4 the bullet pass pam my little boy and he 1 called that he was shot I 1 am sure it passed over the boys arm not more than an inch away then came up about 80 yards and fired again this time at my husband and little girl I 1 heard no conversation I 1 saw the second bullet strike near my husband h and within afoot a foot of my little girl I 1 found the bullet afterward the second shot came up tomy husband who said what do you mean by shooting at my little nellie we did up the sheep I 1 was determined he should not have the sheep if he dropped me my husband told little nellie to go home lest she would get hurt came up to about a rod and a half from my husband I 1 was about four rods to one side my boy frankie was behind his father and ed was between me and him was bringing his gun up and mchusband my husband brought his up first lost time by squaring it to his shoulder it was a question of who was quickest my husband had a double breach loading herder and I 1 told lold him he was over there he went and saw him on the ground and said oh joe are you dead I 1 wanted my hus band to get to town because if he stayed there would be more shooting began to bring his hia gun up before my husband moved my husband had his gun up and lowered lowler ed it and shot he had his hia gun to shoot rabbits I 1 know of no trouble between my husband and my boy said that had made threats against my husband we have seen shots in our granary and found balls there has been been no shooting lately that I 1 know of I 1 saw the bullet picked up near my little girl and it was the same size as Wal keys gun there was a dog with my husband shot the dog in the foot after was killed we are frequently annoyed by do de motts sheep they were there yesterday on the morning of the shooting one of tho the boys went with my husband and the other went with me it was hard to drive the sheep I 1 s w coming from de motts house with a gun and I 1 knew there would be trouble to judge mckay there was a dog shot by my husband after he killed and before he left for town he shot the dog because he was trying to get the sheep away that was after his master was dead he would have got the sheep away if my husband had not shot him this was five or ten minutes after was killed I 1 took no interest in the dog at this point a recess was taken till 3 pm this afternoon charles francis gilmer ilmer Gf son so of the defendant testified I 1 T was fourteen years old last spring wars waa with father on last monday morning we went to diga dig a rabbit out that wy father had bad shot the day previous I 1 do not know how long we were at the rabbit hole but we did not got get the rabbit after we gave up the rabbit saw old demotts sheep on our land about or of them came on the land altogether therall they all came on to the land while we were at the rabbit hole we were about two hundred yards from where the sheep came on we went from the rabbit hole and started to drive the sheep home about a mile distant it would have been easier to have d riven driven them off the laud land the same way they came on than to have driven them down to the house the reason we drove them down to the house was because we wanted to corral them it took us about three quarters of an hour to drive them down I 1 had known joe for more than a year but I 1 have no idea how bow old he was he told me once that if my father ever took any of his sheep he would kill him on the morning was killed I 1 first saw him about one and a half miles west of our house we were about two hundred yards west of the house aheu he first fired his gun the bullet from which very nearly struck my iny little brother I 1 know it nea nearly nealy ly struck him because he told me so we paid no attention dog which my papa shot pa did not go near the body at all hu ho paid no attention to it but attended to the sheep I 1 never had any trouble with and I 1 do not think pa ever had bad ant an he was talking about a suit we had ad with henry he made the remark about killing father if he ever took any of his sheep the williams case was one in which my pa sued williams for trespass because the batters lat sheep ran on our land last spring said we were the damndest damnedest damn dest folks on earth there was no trouble between and my folks that I 1 know of the deputies got out there in the afternoon some hours after the killing which occurred about 8 or 9 the body was lying where it fell when the officers came there they went and looked at the body and I 1 told some of them how it fired from Wal keys gun eddie gilmor a younger son of the defendant was the next witness called he testified it was broad daylight when pa and frank went to dig a bunny up so they could get some work done that day they took a shovel and a shotgun with them I 1 loaded some shells on sunday putting in four drachms drachma of powder and one and an ei eighth ounce of no 2 shot I 1 mi milked six cows while they were gone when I 1 saw pa and charley returning they had a bunch of sheep with them this witness told tola a similar story to that related by his elder brother alleging that the first time person when we went out after the shee sheep p if anyone had bad been within half a mile or a mile I 1 would have seen them when demotts boy got to his house I 1 saw two men leave it together one of them was the other came only a short distance cross examined I 1 and my father were about one fourth of a mile from demotts house when his boy left us to go home and about one mile from our house the country between our house and demotts is level there is a hollow about one hundred yards south of our house we |
