Show THE OGDEN TROUBLE efforts to have thell registration ordinance nullified A few days since one C D hays of ogden ap applied tait led in the first district court at that place for a writ of mandamus to compel registrar corey to place his name on I 1 the he rolls as an aa elector of the second ward of that city under the ordinance recently passed the officer pro proposed ased to enroll him as a voter at large but not accepted hence the suit which has for or it its Is plain object and intent the etting of the ordinance erdl nance aside the case was being heard beard in ogden today I 1 following is hays petition ieti tion which tel tells Is its own story C D hays being duly sworn says on me azu day ui ix 1000 the city council of ogden city utah duly passed an ordinance dividing ogden city into wards and providing forthe for the registration of electors of et ca the following is a true copy evere here follows the city ordinance in full that this affiant is in an elector in ogden city Uta band and is a rep resident ident of cf i tile the second ward of said city that this affiant to is a duly qualified elector and under the iwas of the united states and of utah uta territory and by virtue of the said ordinance he be I 1 is a entitled to be registered in said second ward and to vote therein at the coming city election in said city that on the eth day of december IM 1888 george L corey was the duly qualified and acting registrar of ogden city utah and on the da defy last aforesaid this affiant applied to said george L corey at his office in said city at the hour of 11 a in on that day and requested to be registered as an elector of ef said second ward in said city as established by said ordinance and then and there offered and subscribe the oath prescribed by law for electors to take as a condition precedent to the right to register and vote but said george L corey then and there refused to register this affiant as an elector of the second ward but did offer to register affiant as an elector at large larg e in SRI said d city which this affiant t refused to permit the affiant is beneficially interested in having baving said george L corey registrar as aforesaid register this amant affiant as 88 an elector in said second ward and that he has bas no plain speedy and adequate remedy in the ordinary course of law wherefore atu affiant prays the issuance of the writ ot mandate in his behalf and that defendant be compelled to regist er affiant as elector in said second ward of said city and that affiant recover his costs herein and he prays for all a 2 proper relief subscribed and sworn to dec oth 1888 before me J JT T black U bacom miss missioner doner I 1 A AK ii heywood attorney for petitioner tio rier |
