| Show WHO OWNS THE two residents of koosharem Koo sharem plate county have addressed to the NEWS the following communication will you please answer the follow bog question of general interest A mr A claimed some springs one and a half miles north of this thiis place in 1877 work was done by him towards getting out the water of tuese these springs a ditch about ten rods long the springs w were ere taken take i n out into that d it eh here B stooped his work in this direction A party of settlers now came alons and commenced to make a canal to take the water out of the main creek which flows flaws through the valley They started to work in close proximity to these springs there B joined ined in with the compa company nyana and became a shareholder by working on the canal right here lie he gave up lip the springs and his private ditch as private property the springs and ahe be water from the main cr creek eek flowed lato I 1 the canal and chereb thereby y became mixed together B has been using this water on his land and has subjected himself to the rules and regulations ot of the irrigating ri company the same as the other shareholders that short ditch he made was nearly half a mile from his land B sold las his land and bought it back again the springs were not mentioned bought nor sold bold B now claims those springs he be first mentioned his claim a year ago last spring who is the legal owner of those springs B or the irrigating company according to the above showing B never acquired ownership of or title to the waters of the springs A right to water is acquired by actual actually I 1 y appropriating opria ting it to some useful purpose Y B did not do this he dug a ditch a short distance and turned the water uto nto it bat this was not such an appropriation as the law requires la in order to have perfected his bis title to the waters of those Sp springs kings B should have actually irrigated land with them or he should I 1 have maide made an actual and tangible application of them to some other useful purpose such as propelling machinery etc simply digging a ditch C and tur turning ning water into it will not gi give ve title to the water it must actual actually I 1 y be used f for or some useful pu purpose ose a aad h d not till th this is is done is the water w ter krisht ri IL t acquired As the irrigating company were the first to actually apply the waters of the springs to a useful purpose they became the owners of those i waters it is unnecessary to notice botic e any other points of this case as the above feature decides it providing the facts are as represented |
