| Show before the commissioner H P folsom was on trial before commissioner norrell today on a charge of malicious destruction of property he owns a tract of land bordering on the hot springs lake during the early spring the waters of tile the lake come up to mr folsome Fol land where the shore formerly was of recent years yeara the lake has been gra gradually duall receding and during the dry aloia season there is a strip of lard below mr folsome Fol that becomes dry under the idea that the owners of laud land on the lake shore had title to the centre of the lake and when it receded could follow it up on the lake front to the waters edge mr folsom took possession of that portion of the lake bed hat became dry and for the purpose of using it as a pasture fenced it in about five years yeara ago this land has as yet been py the government about ten days ago a number of parties among them mr bamberger mr hurd and mr J W phillips came on to this land claimed by mr folsom and to do so broke down the batters lat fence he ordered them off but they refused to go and put up a shant shanty y he removed the building and a few days later hurd and phillips erected it a again altin on monday morning Mr Folsom having vine the understanding that hurd and philips were land jumpers and were trying to rob him of his property tore down the building again for this he was arrested during daring the trial mr hurd testified that mr folsome Fol fence had been claimed by L LD D kinney who gave him permission to break through it subsequently mr kinney stated t to mr folsum folsom that no such permission had been kiven given by him to any one mr hurd also stated that the tha united states land office in this city had bad directed him to take up the tract in dispute As the trial of the case involves the searching of land and office records it will not be determined until tomorrow |
