Show SWEENEY ON TRIAL for being connected with avith the murder of Q G J hughes the case ot of the people vs john P sweeney was taken up in the third district court this morning W J clarke and harmel pratt pi prosecuting and judge powers defending thede the defendant in this case is charged murder in the first degree decree in being associated with neal mulloy malloy in the murder of george J hughes at park city august 1 1887 mulloy who fired the fatal shot was convicted of murder in the second degree and is ie now serving out a twelve years term in the penitentiary the defendant mr sweeney was brought down from the penitentiary this morning ana at the opening opt of the court took his seat beside his coun counsel el lie he carries a downcast look and only glances around occasionally he seemed considerably worried by the position in which he is placed and has more apparent concern for the out come than any defendant that has been tried on a similar charge during the past two or three years his wife and little girl were in attendance mrs sweeney occupying a chair just in the rear of where ht tr r husband sat while the child climbed up on her fathers knee an open venire was issued for jurors agthe regular panel was not consid ered sufficient only one of the new tal esmen mr A Woodruff was necessary however to complete the twelve W who ho were sworn to try the case all others were excused till 10 am a m on friday most of the witnesses in the case had bad failed to appear and an attachment was issued for them neal mul loy is wanted as dau tf witness and was ordered brought down from the penitentiary tent iary axy for anat purpose tomorrow the indictment was read to the jury jary and the case opened the prosecution expect to prove the follow following ln 9 facts as stated by assistant district attorney clarke tile drist of august 1887 was wan election day at park city on the evening of that dal day G J hughes went into cupit brennann Bren nans saloon and met neal mulloy they had a conversation about voting and mulloy malloy said he had scratched the ticket hushes hughes said he had voted the straight ticket although there were some men on it whom lle be did not care much lor for mulloy malloy remarked that no man could compel him to do what he did not want to and burbes expressed himself similarly mulloy malloy tauntingly said that hu highes s had been once to do something that he did didiot not want to do hughes replied yes when he was forced to run a train to when jack murphy was Ayn lynched ched mulloy malloy then said that hughes knew every man on the train hughes replied that be did not for they were masked mulloy then cal called led the other a liar and challenged him out to light fight hughes said he did not want any trouble but finally agreed to go out and settle it they went out into a cohered alley along the south side of the saloon up a staircase on to a platform and out into the yard at the back of the saloon when the men got on to the platform sweeney said to mulloy are you heeled peg the s of a G b 11 sweeney rushed down into the saloon tor for a revolver while he be was gone the friends of hughes hughea and mulloy malloy got the matter somewhat quieted and the two men started back hughes going first just then sweeney reappeared on the scene banded mulloy malloy a pistol and told him to shoot hughes the latter was again challenged by mulloy and seeing the weapon began to retreat mulloy followed and shot him inflicting a wound from which he died that night it is for this connection with the affair that sweeney is now on trial for his bis life the trial is likely to last laist three days |
