his family A communication was received from the house announcing the passage by that body of H F no 29 a bill in relation to the branding herding ands care of stock etc read by its title and referred to the committee on agriculture a kicul W K reid prosecuting attorney ol of sanpete county petitioned jor for the sum of 73 to reimburse h him I 1 in for assisting in the prosecution of follett anti and farmer pi charged with murder referred to the committee on claims and public accounts mr grover from the committee on agriculture reported back H P F no 20 a bill to encourage the growth growt h ol of timber with amendments ment menti i were read and adopted and the bill placed on file for second reading 11 mr francis introduced C F N no 0 36 a bill to amend section chapter 11 title 86 of the code ot of civil civi I 1 procedure priced are read the first time and referred to the committee on judiciary the special order OL of the day C F no 29 a bill to provide revenue for the territory of utah and the several counties thereof was men taken up mr hammond in in support of his motion to add and three mills on the dollar for the support of district schools in section one said that ahat while this amendment would not establish free schools it would be a step in that direction he favored liberal education that the young may grow up to be intelligent voters voter 4 and that when they are called upon to exercise the right of franchise they would make a proper choice of public officers it was true the people of utah had but little bittle to do in such matters as they had but few offices to till fill yet education would prepare the young people of utah for the proper and intelligent exercise not only of this right but of all others that were gevea them by the state ane commonwealth should provide for the education of those children whose parents were not able to educate them it was incumbent on the states and territories to do so he maintained that it was cheaper and far better to educate children thereby qualifying them to become in tell telli igent geitt in all the avocations of life rather rath bitnar than be brought up in ignorance lie he admitted that the principle of taxation was opposed by bowe boon on the ground that they were paying a 1 double tax for the education of their children the amendment was the only means of assisting the district schools outside of charitable institutions he was aware that the assistance given to these schools had bad done much to bring them to their present standard of excellence mr sharp hoped the amendment would not prevail popular clamor he knew was in favor coffree of free education but this clamor would not induce him to vote away the peoples money so that one class could be educated at the expense of another he was as much uc opposed to the state adminis administering terin in educational matters as he w was to its interfering in matter of religion the amendment proposed was a very small step in the direction of free schools but aken it curtails the right of the citizen to say how where and and when hill hid child should be educated he would antagonize tag onize it it was not right for the government to educate children under despotic rule the state supervised the whole system of education thereby perpetuating this rule role of tyranny and despotism despotis in in the he minds of the young state taxa tax tion would lead to everything that was opposed to the great republican principles of our free government he could not close hla his eyes to the hatred that existed in this community for this system stem of taxation nor fail to see that il if taxation for free schools became the law it would require legislation to compel a portion of the population to send their children to these schools yet it was proposed to compel them by this tax to aid in their support mr air francis said it was impossible to establish free schools the taxable property being inadequate yet this amendment would be a halt hall way step in that direction and would induce the people in their various districts to add thereto thus enabling them to support their common school system this t iree mills on the dollar had been the I 1 lifes fes blood of the schools and if it were taken awa away our school system would be killey killed there were many who did not appreciate the advantages of a good education there were also numbers of poor but bright children and ae he was in hi tavor favor of placing within their reach every advantage that education could give lie he would call their attention to the school s systems stems of england and germany there mere the governments govern merits compelled the people to educate their children and provided amply to aid them in so doing and where in this world could a freer people be found yet neither religion nor politics opre were any part of their school take away the me aid that this taxation had fauna given ven and again would be found the poor teacher and still poorer school he would favor the amendment which had done so much good during the past eight years and nd although it did not give us free schools it would be a great advantage to the people of utah mr rage page favored the amendment the fair condition of the schools throughout the territory was due to the aid given by this tax of three mills on the dollar if this measure was put to the popular vote he was satisfied there would be a very large majority in its favor mr barton could not support the amendment all legislation should secure justice and equal rights to all the state had no right to interfere or determine the education of children this was absolutely a family right he wanted the privilege e of educating his bis own children and allowing others the same right I 1 the people of this territory were abundantly able to give to their children not only a common school education but also to educate them in the higher branches and they were doing so he believed the statistics of crime were quite as heavy now as when there was no public aid given to schools mr hammond paid a glowing tribute to the present educational system of the territory and trusted the good already gained would be continued the amendment was then put to vote ayes 4 hammond francis page and shurtliff noes 6 barton grover reybourne Hey bourne slack sharp and tuttle on motion of mr grover the bill passed the president adding his vote making the majority seven the title of this bill was approved proved and the house ordered to approved ag be e notified of its passage recommended that the council and house bills for this purpose be consolidated filed tor for second reading the same gentleman reported a bill relation to the incorporation of pleasant grove city read first time and filed tor for second second reading mr smoot from the committee on the asylum for the insane presented a report in reference to council bill 28 26 amending section 2 of chapter 31 session laws of 1880 providing for the election ot of the board of directors for I 1 tekele the territorial insane asylum and asked ta that rz tit it be put on its passage I 1 filed for second reading mr howell from the committee on highways recommended favorably tile the petitioners petition ers of kane county asking the transfer of 1000 to long valley to build a road it recommended that the probate judge of said county be authorized zed to draw the amount adopted the same member also reported favorably to the petition of citizens of garfield county for similar purposes also recommended that 1500 be appropriated to aid in building a road in kane county adopted mr hatch of the committee on en judiciary recommended that the bill on the enforcement of liens be put on its passage adopted and filed to come up again in its order mr west presented a bill prescribing the qualifications of electors etc read by title and referred to the committee on elections mr west also presented a bill for a territorial board of equalization read bead the first time by title and referred to the committee on ways and means A bill repealing an act to amend an act to incorporate alpine city and providing a substitute for the same was read and the rules being suspended was passerby pass edby a unanimous vote house bill 9 in relation to the selection and payment of jurors in utah territory a new bill in lieu of the one vetoed by the governor was taken up and after reading the rules were suspended and it was read by its title and passed by a vote of 20 to 1 the billi bill in relation to the practice and selling of medicines medi cinas was then read the second time it makes any person guilty of a misdemeanor who shall hereafter ere after be found practicing or selling medicine without a diploma or license after reading the enacting clause was stricken out and the bill was assassinated and consigned to oblivion A bill for an act to amend the charter of the city of richfield next came up for ithe consideration of the solons the documents was read the seco second n d time by sections the amendments adopted and thi the e bill filed for third reading the duncil council notified I 1 the house that it had passed the council bill providing for revenue which was read by its title and referred to the committee on ways and means the rules were suspended and the bill to amend the act establishing a territorial insane asylum was read the third time and after some considerable debate a motion to pass it was lost by a vote of 11 noes to 9 ayes like its predecessor it died for lack of support the proposed amendment is as follows that section 2 of chapter 31 session laws of 1880 entitled an act to establish a territorial insane asylum lum be and the same is hereby amended by striking out all after the word qualified fled in line nine of said section up to and including the word situated in line twelve council bill 3 and house bill 6 consolidated soli dated for amending
