two persons 0 H smith and W C nuck Buck were caught boiling selling liquor by a spotter em cloyed by the city authorities and were found guilty and fined by alderman cummings who is also ex cz officio justice of the peace they appealed to the third DI district court and on wednesday december ath 6 th their caso case came up for trial before judge emerson at ogden J L I 1 rawlins raw Baw lins esq appeared for logan city higbee and smith of ogden anci and willard crawford esq of oxford forthe for the defendants the jurors were examined by defendants counsel en cu the question of polygamy ys and one ones declining to answer was challenged for cause judge emerson promptly overruled the objection when the juror was peremptorily challenged and continuing thia this kind of challenging the panel unless in eases cases of for bigamy polygamy or unlawful cohabitation the same defendants were next charged with the same bame offense in another case and a j ury was emean elied but after clear proof result hyrum edwards was then put on trial for sailing bolling beer and aud was found guilty but notice was given of a motion for a new trial which will be argued at a future time incidental to the second case of athe the first named defendants the vapidity of the ordinance was tested but it was found that the charter waa was too plain and definite in giving prohibitory powers to the city council and his honor ruled in its favor this is a very important point and the position taken by judge el emerson mer upon it will strengthen the hands of the supporters of law and order in tile we hope the authorities of logan city will not be discouraged or dis heartened by the temporary obstructions which have been bren placed in the way of strict enforcement of the law by perce fence
