Jake Garn has announced his support of the Equal Access to the Courts (R-U- t) act. Senator Garn said he has joined with Senator James Buckley of New York in spon- soring the legislation which guarantees that a prevailing party in a lawsuit against the U.S. government will be entitled to appropriate legal fees and other expenses". As it stands now, govern- ment is very difficult to fight, Senator Garn said. If you feel you have been wronged by part of this vast network of bureaus which controls our lives and want to take it to court, even if you feel you are right and have a good chance of winning, chances are you cant afford to fight it. I feel this is one reason the bureaus are as arrogant as they are; what have they to fear? They have large batteries of attorneys, federal district attorneys, and Justice department and large sums of money. Yes, large corporations, unions and so forth can afford to fight; they have the resources to do so. But the little guy, the small businessman or the individual citizen, does not generally have the resources and can't afford to find out if, in fact, he has been wronged. We want to correct that. if the little guy does fight and if he does win, the government ought to pay his expenses. Every citizen in this country, regardless of his financial status, should have the right to sue for redress of grievances, especially from the federal gov- ernment, without worrying it about putting him in the poor house. The Equal Access to the Courts act would make that a reality." Senator Garn said the costs and expenses would be paid from the general fund by the General Accounting office as is presently done when the government loses a case and damages are awarded.
