Kyle P. Johnson appeared for arraignment on a charge of distribution of a controlled substance for value. He asked for time in which to consult with an attorney. Upon determining that defendant is without adequate funds to hire an attorney, the court appointed Paul Mortensen, and the case was continued to April 7. Angelo Anthony Melo appeared for arraignment on a charge of rape of a child. He entered a plea of innocent and jury trial was set for June 19 and 20. Juan Carlos Arce and Alvaro Jose Posada appeared for a change of plea on a charge of possession of a controlled substance. Grand County Attorney Bill Benge informed the court that he was willing to reduce the charge and accept guilty pleas. Defendants entered pleas of guilty to the lesser included offense of possession of a controlled substance (marijuana). y The waiting period for ' sentencing was waived and defendants were both sentenced to pay a fine of $250, to be deducted from bail posted, with the remainder of bail to be refunded. Troy Allen Rogers appeared for sentencing on charges of burglary and theft. The court had reviewed evaluation by the Departthe ment of Corrections and sentenced Rogers to 0 to 5 years in the State Prison. The prison sentence was stayed, and defendant was placed on 18 months probation, and also ordered to pay $60 restitution. He was also ordered to complete the current work release program in Salt Lake City and to remain in the custody of the Department of Corrections. In addition, he is to e maintain employment and to Refrain from use of drugs or two-da- 90-d- ay full-tim- alcohol. made to dismiss charges on the grounds that both defendants are currently serving prison sentences on similar charges in the State of Kansas. Motion was granted and the cases dismissed. In State vs. Dave Fitzsimmons on two counts of distribution of a controlled substance for value, the court was advised there was a failure of service on an order to show cause, and a bench warrant was requested. The court authorized the issuance of a bench warrant, returnable on the Law and Motion Day following arrest. The case of State vs. Thomas Jeffrey Hastings, convicted of theft, was before the court on a probation violation.
