(AP) Faced with a family fighting over a man with Alzheimer's disease, a judge had a decision he saw as a choice between life and death. In the end, he granted custody to a son committed to keeping the man alive, rather than a wife who had a "determined plan" for her husband to kill himself with help from Dr. Jack Kevorkian. Probate Judge Fred Mulhauser ruled Tuesday in favor of Chip Klooster, in what legal experts say may be the first time someone has gone to court to prevent an assisted suicide by a relative. "Chip Klooster was apparently the only person who felt bold enough to act," Mulhauser said. "Through his efforts, it is not too dramatic to say that his father's life may have been spared." Mulhauser ruled that returning Gerald Klooster, 69, to his Castro Valley, Calif., home would be dangerous because he was not convinced his wife, Ruth, had given up her plans to arrange an assisted , - S . . ,it3 "im 4 Lees?1' - at risk from tuberculosis '' MIAMI (AP) i ,:? hM' s $f& iTy Ni In The judge extended a temporary order issued in December that gave custody to Chip Klooster. During the hearing, Gerald Klooster sat quietly and showed no emotion. He has been described as mentally incompetent, but his attorney said the man has some sense that the family is fighting over him. The elder Klooster retired as an obstetrician and gynecologist after he with was diagnosed Alzheimer's six years ago. Chip Klooster said he learned last summer that his mother had joined the Hemlock Society, which suicide supports physician-assiste- d for terminally ill people who want it, and that she had spoken with Kevorkian. Then he started coughing blood all over the place," Reardon, a New Yorker on vacation, said Tuesday from her Fort Lauderdale hotel room. It turned out the man has tuberculosis and now health officials are asking hundreds of passengers to get tested for the disease, which can be spread through close contact. The man, w ho had been on two Amtrak trains between Chicago and Miami, was taken off Sunday in Starke. He was in fair condition at University Medical Center in Jacksonville. The two trains made 35 stops in 10 states. Amtrak has taken six cars out of service .a " AP Photo Mich., Monday. A judge ruled Tuesday that the senior Klooster should stay with his son to prevent an assisted suicide. In November, Chip Klooster went to Florida, where his parents were visiting friends, distracted his mother with a phone call and spirited his father away to Michigan. Testimony showed Mrs. Klooster had reserved plane tickets for her and her husband to fly to Detroit last November and had booked a room in a motel near Maureen Reardon noticed a man coughing, wheezing and sniffling on the New J i hi' ' w suicide. Subpoena creates conflict between lawyer, Clintons WASHINGTON (AP) By calling Hillary Rodham Clinton's attorney before a grand jury, Whitewater prosecutors may be putting the lawyer at odds with his clients. Representing the president and the first lady, attorney David Kendall was responsible for carrying out the search for Mrs. Clinton's billing records that outline her work a decade ago for her Whitewater partner's savings and . loan. The records first subpoenaed two years ago by prosecutors weren't produced until Jan. 5. Carolyn Huber, a longtime Clinton aide, told a Senate committee hearing last week she found the documents Jan. 4 in her White House office. Legal scholars say Kendall now is in the unenviable position of having to defend his own conduct as well as that of his clients. In her testimony to the Senate Whitewater Committee, Huber detailed some of the extensive searches for the billing records done at the White House by representatives of Kendall's firm under his direction. The White House disclosed Monday that Kendall and Mrs. Clinton had received subpoenas to appear before the Whitewater grand jury empaneled at the U.S. Mrs. Clinton's Courthouse. appearance is scheduled for Friday and Kendall will testify later. "This is ripening into a possible conflict" between Kendall and the Clintons, said Paul Rothstein, professor of law at Georgetown University. One possible question: whether the president or Mrs. Clinton told Kendall that particular locations in the White House were unlikely to contain the subpoenaed records. Kendall "may want to reveal things the clients have told him but which he cannot say because relationof the attorney-clieship," Rothstein added. Notwithstanding his own status as an upcoming grand jury witness, Kendall said Tuesday night that he continues to represent the Clintons. He declined to elaborate, not even to say whether he has retained his own lawyer to represent him.
