Hotel employees called to the stand Friday repealed the story told by earlier witnesses: Selena, bleeding profusely from a fatal bullet wound, used her dying breath to name Saldivar as her killer. "She said 'Yolanda Saldivar in Room 158,'" Ruben Deleon, sales director at the motel, told jurors in the a Houston courtroom. The trial was moved because of publicity and the singer's popularity in her hometown of Corpus Christi. "She was yelling, 'Help me, help me. I've been shot,'" said Rosalinda Gonzalez, an assistant manager at the motel. "I asked who shot her. She said the lady in Room 158. She moaned. Her eyes rolled up." Front desk clerk Shawna Vela said she dialed 911 and took the phone with her as she kneeled over the fallen singer, asking her what happened. "She said 'Yolanda,' said 'In room 158,"' Vela testified. The gripping, sometimes gruesome testimony pushed Selena's family to tears as Saldivar stoically stared at the witness stand. Selena's brother, A.B. Quintanilla, cried with his head in his hands. His wife, Vangie, wiped away tears and rubbed her husband's back. It was all too tempting for Arthur Younkin, who was sentenced to 93 days in jail Friday lor not obeung 505-poun- d a court order to lose v. eight. Dropping pounds was a condition of Younkin's probation on a - , forgery conviction. Sedgwick County District Judge Clark Owens ordered him to siim down after he said he couldn't pay SI 1,333 in restitution because his weight made him unemployable. On Aug. 25. Owens ruled thai Younkin had violated probation and sft sentencing for Friday. when Younkin showed up carrying an additional 20 pounds. Owens said lie wanted to sentence the former toning salon operator to more than 93 da s. but state law wouldn't allow it "Mr. Younkin is not going to serve much time in jail, and probably the state parole system is not going to make him pay that money back." Younkin's lawyer. Mike Manna, said the order and sentence were unconstitutional because what people choose to eat and weigh is a right of privacy protected by the U.S. Constitution. Manna called the order cruel and unusual. Younkin has been working as a telemarketer and a sales representative for a farm equipment company, and as long as he is making restitution the court shouldn't w or-r- y about his size, his lawyer said. Younkin's legal troubles began in 1990. a year after his business closed. He and his wife, Sandi, had run a salon called Inches Be Gone, w hich included vibrating machines designed to trim fatty flesh. He went on a shopping spree with checks from a checkbook he had found somewhere, buying appliances, groceries and Christa move he later called mas gifts "dumb." He pleaded guilty lo 20 counts of forgery and in 1991 was ordered to pay restitution. He said he couldn't pa because he was too fat to work, but Owen didn't swallow it. The judge sent him to a work-releas- e center and ordered him onto a strict diet, but some ups and downs ensued. Younkin lost 70 pounds in about four months and convinced the judge to release him. then put back about 78 pounds and was hauled d into court for altering the weigh-i- n slips. At one point, people who spotted Younkin chowing down at restaurant buffets notified Owens. court-ordere- |
