After a legal battle through the state courts, the California Supreme Court in May 1982 concluded the state has a public right of easement to such water-covere- d WASHINGTON (UPI) The Supreme Court this week agreed to step into a land dispute that has private owners worried about their freedom to develop some of California's most valuable real estate. The justices next term will review a ruling declaring the state has a "public trust" right over shallow wetlands that have been privately owned since at least 1848, before California became a state. The dispute affects scores of sloughs, creeks and lagoons lying inland from California's coastal beaches. Summa Corp. argues the ruling could give the state power over wetlands along 670 miles of California coastline, precluding "virtually all use of the lands by lands have been filled and developed. A portion of the lagoon is owned by Summa Corp., founded by the late millionaire recluse Howard Hughes. The city claimed it has a right of easement to the lagoon, and wanted to dredge it for public use. Not only does the state court's decision violates the 1848 treaty, the department warned, it will damage private landowners in California and could be copied by other states with submerged lands.
