Show CASTLE VALLEY TIMES DUBIOUS TIMES - AUGUST 15, 1998 - TOWN OF CASTLE VALLEY, UTAH ORDINANCE 99—\ AN ORDINANCE REGARDING HUNTING AND DISCHARGE OF FIREARMS WITHIN THE BOUNDARIES OF THE TOWN OF CASTLE VALLEY WHEREAS. the Town of Castle Valley is a residential area with residences, buildings. and an increasing number of residents situated in an area interspersed with and surrounded by land owned by the Bureau of Land Management and the State of Utah, without clear separations between the various ownerships; and WHEREAS, residents and visitors are at risk ofiujury from hunting activities within certain portions ofthe Town; and WHEREAS, property has been damaged through the discharge of firearms within the boundaries of the Town; and WHEREAS, hunters have been hunting increasingly close to residences within the Town, trespassing upon private property and putting said residents at risk for personal injury and property damage; and WHEREAS, the Town Council finds and determines that hunting with firearms within the boundaries of the Town of Castle Valley (except for the areas specified herein) would be extremely dangerous and would jeopardize the health, safety and welfare of residents and visitors; therefore: BE IT ORDAINED BY THE TOWN OF CASTLE VALLEY, UTAH: SECTION I. It shall be unlawful for any person to use any gun, revolver, or firearm of any kind or nature, or any spring gun, steel trap, or similar device, for the purposes of hunting, capturing, or trapping any protected wildlife, in any area within the confines of the corporate limits of the Town of Castle Valley, whether on public or private land, except in the area indicated on the accompanying map. Nets, snares, or similar devices may only be used on owner’s private property. SECTION 2. Hunting is permitted only on the land owned by the Bureau of Land Management and the State of Utah, in the southern portions of the Town as indicated on the accompanying map‘ No hunting is permitted within the Castle Valley River Ranchos subdivision Units I or II. ‘ SECTION 3. It shall be unlawful to discharge a firearm within 600 feet of any residence, cabin, or other building within the Town of Castle Valley. However, a firearm for the slaughtering of domestic livestock or a shotgun up to 7 chill for varmint control, may be used in such a manner that the projectile does not exit that owner's property. SECTION 4. Neither hunting with bows and arrows nor the discharge of air—propelled pellet or BB guns is regulated by this ordinance. ' SECTION 5. Severability: if a court of competent jurisdiction declares any provision of this ordinance invalid, the remainder shall not be affected thereby. SECTION 6. Any violation of this ordinance is a Class B misdemeanor. SECTION 7. Effective date: this ordinance shall take effect immediately upon posting as required by law.
