I 1 - " ORDINANCE 4-1 te 25 AN ORDINANCE REPEALING REPEAL-ING CHAPTER 4, SECTION 1 to 25, OF THE REVISED ORDINANCE OR-DINANCE OF AMERICAN FORK CITY CODE 1970, AND ENACTING A NEW ORDINANCE ORDIN-ANCE RELATING TO ANI-MALS ANI-MALS AND FOWL. BE IT ORDAINED BY THE CITY COUNCIL OF AMERICAN AMERI-CAN FORK CITY, UTAH: ARTICLE 1. MANAGEMENT. SECTION 4-1. POWER AND AUTHORITY OF ANIMAL REGULATION OFFICER. In the performance of his duties, the Animal Regulation Officer is hereby vested with the same power and authority as police officers within the City Police Department and the recipient thereof shall be duly sworn in as an Animal Regulation Officer. Section 4-2. ENFORCEMENT AND PENALTY. A. The Animal Regulation Officer or deputy thereof, assigned as-signed to duties which include the enforement of Animal Regulation Laws and any peace officer are responsible for enforcing the provisions of this chapter and other provisions provi-sions of state law which they have a duty to enforce. B. Each of the individuals referred to in paragraph (A) above shall have the power to make arrests for violations of those provisions of this chapter and of state law which he has a duty to enforce and to issue citations for such violations. viola-tions. C. Investigations. The Animal Ani-mal Regulation Officer, public health officer and any peace officer, may enter upon privately priva-tely owned land to investigate reports of vicious animals, rabies, or other contagious animal an-imal diseases, and to investigate investi-gate violations of and enforce the provisions of this chapter. D. Right of Entry in Fresh Pursuit. In the enforcement of any provision of this chapter, any Animal Regulation Officer or authorized agent or deputy may enter the premises of any person to take possession of , registered or unregistered, ' Jerce, dangerous,, or visipus f i animals when in fresh pursuit... of such animal at the time said animal joes onto private property. E. Hindering and Obstructing Obstruct-ing Enforcement. It shall be unlawful for any person to interfere in-terfere with, molest, hinder or prevent the Animal Regulation Officer from discharging his duties. Any pe.son who shall hinder, delay, interfere with, or obstruct the Animal Regulation Regu-lation Officer while engaging in capturing, securing or taking tak-ing to the animal shelter any animal or animals to be impounded, im-pounded, or who shall break open or in any manner directly or indirectly aid, counsel, or advise the breaking open of any animal shelter or ambulance, ambu-lance, wagon or other vehicle used for the collecting or conveying con-veying of any animals to the shelter shall be deemed guilty or a misdemeanor. F. Public Nuisance. The introduction, in-troduction, possession or maintenance of any animal, or the allowing of any animal to be in violation of this chapter is in addition to being an infraction in-fraction or misdemeanor, hereby her-eby declared to be a public nuisance. The Animal Regulation Regula-tion Officer, public health officer of-ficer and peace officers, are hereby authorized, directed and empowered to summarily abate any such public nuisance nui-sance by any means reasonably reasona-bly necessary including but not limited to the destruction of the animal or animals involved. in-volved. G. Penalty. Any person violating vio-lating any provisions of this chapter shall be guilty of an infraction and unless a different differ-ent penalty shall be provided for such violation by this chapter such violation shall be punished by a fine in any sum not exceeding $50.00. SECTION 4-3. REGISTRATION, REGISTRA-TION, LICENSE FEE. (1) It shall be unlawfull for any person to own, keep, harbor or maintain any dog within the city limits of American Ameri-can Fork City which has attained at-tained the age of four (4) months unless and until such dog has been duly licensed and registered as hereinafter provided. (2) The license required by paragraph (1) of the above shall be issued by the Department Depart-ment of Animal Control upon payment by the applicant of a fee therefore of 55.00 for each male dog, sppyed female dog and unspayed female dog. Said payments may be paid by the applicant to the office of the City Treasurer or directly to the Director of the Department Depart-ment of Animal Control. (3) License fees provided in the last paragraph shall cover the calendar year in which the license is issued and said license shall expire on the ,31st day of December of the year in which it is issued regardless of the date of issuance. (4) The annual license fee provided for above shall be paid for each dog, male or female, kept within the limits of American Fork City. Said fee shall be due on or before the 1st working day in January of each year and shall be delinquent or subject to the penalties hereinafter provided if unpaid on or before the last day of February of each year. Upon the failure to pay the license fee provided in paragraph para-graph (2) above on or before the last day of February of each calendar year, said fee shall be increased to $10.00 for each male dog, spayed female dog and unspayed female dog. Dogs turning four (4) months old after February 28th or a newly acquired dog must be licensed within (15) fifteen days. The penalties provided for in this paragraph shall be in addition to the penalties hereinafter provided for violation viola-tion of this ordinance. SECTION 4-4. VACCINATION OF DOGS. Vaccination Reouired. All dogs over four (4) months of age owned, kept, harbored or in custody of any person in the American Fork City limits, shall be vaccinated at four (4) months of age with an approved ap-proved rabies vaccine produced under U.S.D.A. license. Any dog vaccinated with low egg passage-chicken embryo origin (LEP-CEO) flury type vaccine shall be re-vaccinated every two (2) years. If rabies vaccine other than the LEP-CEO type is used, re-vaccination shall be annually. All rabies, vaccines, because of species limitations, techniques, and tolerances shall be administered only by a veterinarian licensed in his particular state. ARTICLE II. OWNER OBLIGATION SECTION 4-5. CONDITIONS nc tNiMii nvPDute - - Animal owners or keepers must comply with the following follow-ing conditions of animal ownership, ow-nership, and the Animal Regulation Regu-lation Officer may require as a condition of licensing such owners or keepers to sign a contract agreeing to comply with such conditions: A. Animais shall oe restrained res-trained or confined as required by law. B. Animals shall be humanely humane-ly treated at all times. C. Vaccinations, licenses, and permits shall be obtained as required by law. D. Animal premises shall be kept saniary and shall not constitute con-stitute a fly breeding resrvoir, a source of offensive odors or of human or animal disease. E. Animals and animal premises shall not be permitted permit-ted to disturb the peace or constitute a public nuisance or hazard. SECTION 44. APPLICATION OF ARTICLE TO NONRESIDENTS. NONRESI-DENTS. Nothing in this article shall beconstrued to affect persons not residing in this city who may temporarily visit the city and own a dog provided, that such person shall constantly keep such dog under his personal per-sonal care and not allow the same to run at large. Every nonresident dog must be identifiable. iden-tifiable. SECTION 4-7. DOG COLLARS AND TAGS. Every owner shall be required to provide each dog with a collar or harness to which the current year's license tag and current rabies vaccination tag are attached. SECTION 44. RUNNING AT LARGE. It shall be unlawful for any person being the owner or having hav-ing the charge of any horse, cow or other animal, except dogs and cats, to stake the same out or knowingly or intentionally in-tentionally turn the same loose upon the streets, alleys, or public grounds of the city. It shall be unlawful for any person to permit or allow any such animal or fowl to trespass on the property of another within the city. SECTION 4-9. RESTRAINT OF DOGS BY OWNER. Dog owners shall at all times keep their dogs on a leash or within an enclosed area on their own property or the private property of another with permission of owner thereof, ther-eof, and not permit such dog to run at large at any time within the city, or from biting or harrassing any person engaged en-gaged in a lawful act, from interfering with the use of public pub-lic property or with the use of another person's private property, and from being in violation of other sections of this chapter. SECTION 4-10. POSSESSION OF VICIOUS DOG. The possession of a vicious dog is unlawful unless it is restrined, confined, or muzzled muz-zled so that it cannot bite or attack any person or animal. Dogs held in violation of this section shall be deemed a public pub-lic nuisance, and their continued contin-ued possession or ownership shall be unlawful. The Department Depart-ment may impound any such dog and dispose of it in a humane manner after three working days to allow for legal restrining action by the owner. However, nothing contained herein shall prevent the reasonable rea-sonable keeping of a guard dog or dogs for security. SECTION 4-11. DOGS PROHIBITED PROHI-BITED IN PUBLIC PLACE- It shall be unlawful for the owner of any dog to permit the same to enter or be in any public school building while school is in session or to enter or to be in any place of worship wor-ship or any public building. SECTION 4-12. DISTURBING THE PEACE PROHIBITED. No person shall own or harbor har-bor an animal in such a manner man-ner that the peace and quiet of the public is unreasonably disturbed. dis-turbed. The written affirmation affirma-tion by two persons, having separate residences, that the violation disturbs the peace and quiet of said persons shall be prima facie evidence of a violation of this section. The keeping or maintenance, or the permitting to be kept or maintained, on any premises owned, occupied, or controlled by any person of any animal or fowl which, by any frequent or long continued noise, shall cause unreasonable annoyance anno-yance or discomfort to any person of normal sensitivity in the vicinity shall constitute a violation of this section; provided, however, that nothing noth-ing contained herein shall be nonstrued to apply to reasonable reasona-ble noises emanating from legally operated dog and cat hospitals, humane societies, pounds, farm and or agricultural agricul-tural facilities, or areas, where.. . keeping -of animals or fowls are permitted. The destruction by an animal of property other than that which belongs to the owner of said animal shall be prima facie evidence of a violation of this section. SECTION 4-13. FEMALE DOGS IN SEASON. Dog owners shall securely confine their female dogs while in season within an enclosure en-closure in a manner that will prevent the attraction of male dogs to the immediate vicinity. vicini-ty. SECTION 4-14. ABANDONING SICK OR DISABLED ANIMALS. ANI-MALS. It shall be unlawful tor any person to abandon or turn out at large any sick, diseased or disabled animal. Such animals shall, when rendered worthless worth-less by reason of sickness or other disability, be disposed of by the owner. Therefor as provided in Section 4-15 for the disposition of dead animals within the city. It shall be the duty of the police officer of the city to dispose of any animals found running at large within the city which are worthless from sickness, disease or other disability. SECTION 4-15. REMOVAL AND DISPOSITION OF DEAD ANIMALS, ETC. It shall be unlawful for the owner of any animal or fowl that shall die or be killed within with-in the city to fail to remove or bury the carcass of such animal ani-mal within ten hours after its death. No horse, cow, ox or other animal shall be buried within the closely inhabitated portion of the city. ARTICLE III PUBLIC OBLIGATION SECTION 4-16. CRUELTY TO ANIMALS. Any person who, within the city, maliciously kills, maims or wounds any animal which is the property of another, or who maliciously or cruelly beats, tortures, or injures any animal, whether belonging to himself or another, shall be guilty of a misdemeanor. SECTION 4-17. POISONING ANIMALS. Any person who wilfully, unlawfully un-lawfully and maliciously administers ad-ministers any poison to any animal which is the property of another, or who maliciously exposes any poisonous substance sub-stance with intent that the same shall be taken or swallowed swal-lowed by any such animal, shall be guilty of a misdemeanor. misde-meanor. SECTION 4-18. ENCOURAGING ENCOURAG-ING ANIMALS, ETC., TO FIGHT. It shall be unlawful for any person within the city to in any manner whatever encourage or urge dogs or any other animals ani-mals or fowl to fight or urge them after they commence to fight. SECTION 4-19. INJURIES AND COMMUNICABLE DISEASES. DIS-EASES. No person shall knowingly harbor or keep any dog or other animal with a serious injury or afflicted with mange, ringworm, distemper or any other contagious disease, unless un-less such dog or other animal is, in the opinion of the Animal Regulation Officer or the veterinarian, being given adequate ade-quate treatment for such disease. dis-ease. The Animal Regulation Officer or the veterinarian may take immediate possession posses-sion of any such animal not being so treated or which is not responding to such treatment, treat-ment, and immediately dispose dis-pose of the animal unless the owner shall forthwith place such animal under the control and treatment of a licensed veterinarian. SECTION 4-20. RABID ANIMALS. ANI-MALS. A. Reporting. (1) Reporting of bites. All persons bitten and the parents or guardians of minor children bitten by a dog, cat.skunk, fox, bat, coyote, bobcat, or other animal known to constitute a serious threat of rabies shall notify the Animal Regulation Officer immediately thereafter. ther-eafter. Physicians treating such bites and other persons having the knowledge of such bites shall also be required to make such notification. (2) Reporting of suspected rabid animals. Any person who observes or has knowledge know-ledge of an animal which shows symptoms of rabies or which acts in a manner which would lead to a reasonable suspicion that it may have rabies, shall notify the Animal Regulation Officer and comply with appropriate laws and regulations regarding suspected suspect-ed cases of rabies as directed by ..the. Department of Cityfc County Health Department. B. Isolation of Biting or Suspected Rabid Animals. Upon the reasonable order of the Animal Regulation Officer Of-ficer or public health officer, a biting or suspected rabid animal ani-mal shall be isolated, at owner's expense if owned, in struct confinement under proper care and under the observation ob-servation of the Utah County Animal Control Building, or other adequate facility in a manner approved by the Animal Ani-mal Control officer or City-County City-County Health Department. (1) Any biting or suspected rabid animal or bat may be humanely euthanized immediately imme-diately by the Department of Health, and such animal's undamaged un-damaged and properly packaged pack-aged and properly refrigerated refrigerat-ed head shall be delivereJ promptly to an approved medical medi-cal facility having the capability capabi-lity of performing the fluorescent fluores-cent antibody test to demonstrate demon-strate the presence of rabies. (2) The foregoing notwithstanding, notwith-standing, if the biting or suspected rabid animal is of the domesticated variety that is owned or obviously could have an owner, said animal shall be confined as in the above paragraph (B) for a period of five (5) days to allow time for an attempt to locate an owner unless the County Veterinarian or other licensed veterinarian shall reasonably deem it necessary to sacrifice the animal for the purpose of laboratc . examination. ARTICLE IV. ANIMAL CONTROL OBLIGATION SECTION 4-21. RELINQUISHING RELINQUISH-ING AN ANIMAL. Any stray animal must be relinquished to the Animal Regulation Officer within twenty-four. 4) hours. Any person per-son who relinquishes an animal ani-mal to the Animal Control Officer Of-ficer shall give his name, address and, if he is not the owner, the location where he found the animal. SECTION 4-22. NOTIFICATION NOTIFICA-TION OF OWNER OF RECORD. Upon receipt of a lost or stray animal bearing a current year's license tag, the Animal Control Officer shall immediately immedia-tely telephone or mail to the owner of record at the address indicated on the license form, a notice of the location of the animal. Compliance with notice requirements of this section shall be deemed as met if the Animal Control Officer Of-ficer shall have mailed the notice to the owner of record at his address of record, postage pos-tage prepaid. SECTION 4-23. RETURN OF ANIMALS TO THEIR OWNERS. The owner of an impounded animal may claim it prior to its legal disposition by providing provid-ing proper identification, meeting all the legal requirements, require-ments, and paying the applicable applica-ble redemption fees for impoundment, im-poundment, board, medical care, vaccination andor other costs. SECTION 4-24. HOLDING PERIOD AND DISPOSITION. A. The Animal Control Officer Of-ficer shall hold an impounded, lost or stray dog for not less than three working days if it was not wearing a current year's license tag when impounded im-pounded and for not less than five working days after notice is given pursuant to this chapter if it was wearing a current year's license tag, so that the owner or custodian may claim it prior to other disposition. B. The Animal Control Officer Of-ficer may dispose of humanely or may transfer to a new owner upon payment of the applicable fee, any impounded animal not claimed by its owner or custodian within the prescribed holding time. Animals Ani-mals relinquished by their owner may be humanely destroyed des-troyed without regard to the prescribed holding time in order ord-er to alleviate suffering or to protect other impounded animals ani-mals from exposure to a contagious con-tagious disease. SECTION 4-25. WILD ANIMALS ANI-MALS AND REPTILES EXCLUDING EX-CLUDING RODENTS. A. Possessing, Keeping, Maintaining or Harboring. 1. Because of the public health program wherein many of these animals are infected with rabies, the Animal Regulation Regu-lation Officer discourages people peo-ple from having control of such animals. 2. Also due to the fact that so few individuals possess the knowledge andor skill to handle han-dle and feed such animals humanely the Animal Regulation Regula-tion Officer further discourages discour-ages people from having control con-trol of such animals. 3. The foregoing not withstanding, with-standing, if individuals insist on possessing, keeping, maintaining, main-taining, or harboring such animals, ani-mals, the following conditions -shall be met for such animals which are not protected by or for which permits are issued by the Utah Wildlife Resources. A. A permit shall be obtained ob-tained for each animal or wild animal establishment from the Animal Regulation Officer, provided however, this section shall not apply to parks, zoos, pet shops, medical or scientific scienti-fic institutcons or other places licensed for the showing or keeping of wild animals or reptiles. B. Every individual controlling controll-ing or maintaining such animals ani-mals or wild animal establishment establish-ment shall quarantine said animals an-imals as provided for in 4-5 of this chapter. These animals shall be vaccinated for rabies by a licensed veterinarian using us-ing a suitable vaccine for the species as approved by the Utah State Department of Health. C. All such wild animals or reptiles referred to in paragraph para-graph (B) of this section shall be kept under proper confinement confine-ment of the premises and shall not be allowed to run at large and shall be maintained on the premises or private property of the owner in such a manner as to not endanger the life or limb of any person lawfully entering such premises. ARTICLE V. In the opinion of the City Council, it is necessary neces-sary for the immediate preservation preser-vation of the peace, health and safety of American Fork City that this ordinance take effect upon its first publication.
