Based on this review, the City of Orem has determined that a request for release of project funds will not significantly affect the quality of tho human environment and hence, an environmental impact statement will not be undertaken under tho National Environmental Policy Act of 1969 (RL 91-910). PUBLIC COMMENTS ON FINDING All interested agencies, groups, or persons disagreeing with these decisions arc invited to submit written comments for consideration by the City of Orem by May 30, 1997. All commcntsmustclcarlyspecify which decision they object to-thc Find of No Significant Impact or the Request for Release of Funds. All comments so received will be considered by the City of Orem prior to its taking any administrative action or requesting release of funds on the date listed immediately above. RELEASE OF GRANT FUNDS The City of Orem will undertake the projects described above with Block Grant funds from the U.S. Department of Housing and Urban Development (HUD) under Title I of the Housing andCommunity Development Act of 1974. The City of Orem is certifying to HUD that the City of Orem and Stella Welsh in her official capacity as mayor, consent to accept the jurisdiction of tho Federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making, and action; and that these responsibilities respon-sibilities have been satisfied. Tho legal effect of the certification is that upon its approval, the City of Orem may use the Block Grant funds, and HUD will have satisfied its responsibilities under the National Environmental Policy Act of 1969 and other environmental responsibility listed in 24 CFR part 58. HUD will accept an objection to its approval of the release of funds and acceptance of tho certification only if it is on one of the following basis: (a) that tho officer of tho certification was not in fact executed by tho Chief Executive Officer or other officer of the City of Orem; (b) that tho City of Orcm's environmental review record for the project indicated omission of a required decision, finding, or step applicable to the project in the environmental environmen-tal review process, or (c) another Federal agency has submitted written comments pursuant to section 309 of tho Clear Air Act or Section 102(c) of NEPA. Objections must bo prepared and submitted in accordance with the required procedure (2-CFR Part 58), and may be addressed to HUD.
