Repealing any ami all Ordinances in conflict and declaring an emergency. BE IT ORDAINED BY THE CITY COUNCIL OF OREM CITY, UTAH: SECTION I. That Section 29-3-10 of the Revised Ordinances Ordin-ances of Orem City be amended to add the following: 23-3-10-17 PLANNED UNIT SUBDIVISION A. PURPOSE. It is the purpose pur-pose of the Planned Unit Subdivision Subdi-vision approval Procedure to give freedom of action and encouragement en-couragement to the developers to be creative in their use of land and open space by permitting some carefully controlled relief re-lief from the strict application of the provisions of each of the residential zoning districts set forth in this chapter. It allows flexibility and diversification in the relationship of various buildings, structures, and open spaces in planned building groups, and in the maximum allowable residential density, while insuring substantial compliances com-pliances to the zone regulations and other provisions of the zoning code. It is also the intent of this procedure to carry out the general gen-eral purposes of this Title as set forth in Section 29-1-1 by continuing to observe adequate standards related to public-safety, public-safety, health, and general welfare wel-fare without unduly inhibiting the advantages of modern imaginative imag-inative site planning, and to implement the following objectives: ob-jectives: a. To provide for desirable desir-able living environment. b. To encourage the preservation of and the esthetic use of open space. c. To encourage variety in physical development of Orem Citv. B. USE IN COMBINATION. The Planned Unit Subdivision Approval Procedure may be used in combination with the Single Family Residential (R) Zones as set forth in this Title upon approval of the CityCoun-cil CityCoun-cil and the Planning Commission Commiss-ion and in conformance with the procedures set forth herein. C. PERMITTED USES. No other than those uses permitted by the zoning district with which the Planned Unit Subdivision Approval is combined. D. PROJECT AREA. E. . BASIC PRINCIPLES. In considering the use of the Planned Unit Subdivision Approval Procedure, applicants and the City shall be governed by the following requirements: a. Areatdensity) requirements, lot sizes, location requirements, require-ments, and frontage requirements require-ments do not have to meet the specific ordinance requirements, require-ments, provided that piansand exhibits submitted clearly establish es-tablish that the relationship of interior and exterior living or working area is desirable and adequate, and that the living and working environment is just as desirable as the strict requirements re-quirements of the zone; and further provided that the Planning Plan-ning Conunision finds that the other criteria for approval set forth in this Chapter are complied com-plied with. B. Area (density) requirements, require-ments, within a Planned Unit area shall be determined by the underlying zone. The average size of lot within the Planned Unit area shall not be smaller than the size of lot obtainable in the underlying zone. c. A variety of dwelling and building types is to be encouraged. encour-aged. d. Where a dwelling is proposed pro-posed to be constructed with a zero side setback, a solid wall shall be constructed. Any openings open-ings in the solid wall shall be enclosed with obscure and fixed glazing. e. Planned Unit Subdivision approval need not be limited to instances where land is to be devoted to parks or open space, but may be made to permit variety var-iety in the location of dwelling units and variety in lot sizes, providing exemplary livability and amenity are insured and the appearance of the residential neighborhood and street thereby substantially improved. f. All parks and open spaces shall be provided with all required re-quired on-site and off-site improvements in accordance with current Orem City policy, and provisions made for perpetual perpet-ual maintenance through the establishment of a non-profit association with the power and responsibility for assesing property owners for the cost of said maintenance. g. Minimum distances for front, rear, and side yards will be established by the Planning Commission and reflected in the approved plot plans submitted for each lot. F. APPLICATION PROCEDURE. PROCED-URE. The application for Planned Unit Subdivision Approval Ap-proval Procecure shall be submitted sub-mitted to the Ore m C ity Planning Department and shall be accompanied by two (two) copies of the development plan showing the following: a. A tabulation of dwellings proposed for the Planned Unit Development classified by types. b. Location of all proposed structures on the site with full dimensions showing distances between said structures and between structures and property prop-erty lines. c. Areas to be used or reserved re-served for vehicular and pedestrian pedes-trian circulation. d. Automobile parking areas and recreation vehicle storage areas. e. G. FINDINGS OF THE PLANNING PLAN-NING COivlLIISSION AND CITY COUNCIL. In order to grant Planned Unit Subdivision Approval, Ap-proval, the Planning Commission Commis-sion and City Council shall find the following: a. The proponents of the Planned Unit Procedure have demonstrated that they intend to start construction within six (6) months of the approval of the project, and that they intend to complete the construction within with-in a reasonable time as determined deter-mined by said Planning Commission and City Council. b. The proposed Planned Unit Project conforms to the Master Plan of Orem City in terms of general location and general standards of development. c. The development plan justifies exceptions, if such are required, to the normal requirements re-quirements of this Title. H. ACTION BY THE PLANNING PLAN-NING COMMISSION. The Planing Plan-ing Commission shall review all plans and proposals within forty-five (45) days after receipt re-ceipt thereof. The Plaining Commission may hold aheariig on said plans and proposals after which they shall submit a recommendation to the City Council. Said recommendations may be for approval of the application, appli-cation, for denial of said application, or for approval of said application with required modifications or conditions. I. ACTION BY THE CITY COUNCIL. The City Council shall, within thirty (30) days affirm or reject the recommendation recommen-dation of the Planning Corn-mis, Corn-mis, ion, or may take other action as it deems appropriate on the application. J. DEVELOPMENT SUBJECT SUB-JECT TO PLAN. Any Planned Unit, as approved and authorized by the Planning Commission and City Council, shall be developed in all respects re-spects in conformance with plans by these bodies and shall be subiect to all conditions imposed; im-posed; and shall be excepted from provisions of the applicable appli-cable zone and other provisions of this Title only to the extent ex-tent specified in the approval. K. DUTY OF BUILDING INSPECTOR. IN-SPECTOR. Following issuance of Planned Unit Approval by the Planning Commission and City Council, the Building Inspector shal1. insure that development is undertaken and completed in full conformace with the approved plans. L. REVOCATION OF APPROVAL. AP-PROVAL. Planned Unit Approval Ap-proval may be revoked in any case where the conditions of such approval have not been, and are not being compliedwith.
