Show RESOLUTION 97 A RESOLUTION DECLARING THE INTENTION OF THE CITY COUNCIL OF OREM CITY, UTAH COUNTY, STATE OF UTAH, TO CONSTRUCT IMPROVEMENTS IM-PROVEMENTS ON CERTAIN STREETS WITHIN SAID CITY, CONSISTING OF GRADING AND CONSTRUCTING OR RECONSTRUCTING RECON-STRUCTING CURB, GUTTERS, SIDESALKS, STREET PAVING, COMBINATION DRIVEWAY APPROACHES, AND APPURTENANT APPUR-TENANT DRAINAGE FACILITIES; FACIL-ITIES; TOINSTALLSANITARY SEWER LINES, INCLUDING MANHOLES AND APPURTENANT APPURTEN-ANT STRUCTURES; TO INSTALL IN-STALL CULINARY WATER-LINES, WATER-LINES, INCLUDING FIRE HYDRANTS AND VALVRSr; TO INSTALL IRRIGATION DITCH PIPING WITH TURN OUTS AND OTHER APPURTENANTS; APPUR-TENANTS; TO PURCHASE, CONDE MN OR OTHERWISE ACQUIRE ANY PROPERTY IN ORDER TO MAKE SUCH IMPROVEMENTS; IM-PROVEMENTS; TO EXCAVATE, EXCA-VATE, FILL, GRADE, REMOVE RE-MOVE TREES, REMOVE NONCONFORMING NON-CONFORMING IMPROVEMENTS IMPROVE-MENTS AND TO DO OTHER MISCELLANEOUS WORK NECESSARY NE-CESSARY TOCOMPLETE THE IMPROVEMENTS IN A PROPER WORKMANLIKE MANNER; TO CREATE SPECIAL IMPROVEMENT IMPROVE-MENT DISTRICT NO. 0 OF OREM CITY, UTAH COUNTY, UTAH; TO DEFRAY THE COST AND EXPENSES OF SAID IMPROVEMENT IM-PROVEMENT DISTRICT BY SPECIAL ASSESSMENTS TO BE LEVIED AGAINST THE PROPERTY BENEFITED BY SUCH IMPROVEMENTS: PROVIDING PRO-VIDING FOR NOTICE OF IN-TENTIONTO IN-TENTIONTO AUTHORIZE SUCH IMPROVEMENTS AND FIXING A TIME AND PLACE FOR PROTESTS AGAINST SUCH IMPROVEMENTS OR THE CREATION OF SAID DISTRICT. DIS-TRICT. BE IT RESOLVED BY the Mayor and City Council of Ore m City, Utah County, Utah: SECTION 1. TheCityCouncil of Orem City, UtahCounty, Utah hereby determines, that it will be in the best interest of said City to construct curb, gutter, sidewalks, street paving, sanitary sani-tary sewer lines, culinary water lines and appurtenant facilities on certain streets in Orem and to complete the whole in proper and workmanlike manner according ac-cording to plans, profiles and specifications on file in the Office of the City Recorder of Orem City, Utah or at the office of the City Engineers, Rollins, Brown and Gunnell, 1435 West 820 North, Provo, Utah. The streets to De improved and the boundaries of the proposed special improvement district are more particularly described in the notice of intention to construct con-struct the proposed improvements improve-ments hereinafter set forth. SECTION 2. The proposed district shall be known as 'Special 'Spe-cial Improvement District No. 0. SECTION 3. The cost and expenses ex-penses of the proposed improvements im-provements shall be paid by a special tax to be levied against the property fronting or abutting upon or adjacent to the streets or alleys to be improved or which may be affected by or specially benefitted by any of such improvements, such tax to be paid in not more than ten equal annual installments with interest on the unpaid balance and not to exceed 8 per annum until due and thereafter at the rate of 10 per annum until paid. An allowance shall be made for corner lots as provided pro-vided by City Ordinance so that such lots are not assessed at full rate on both streets. SECTION 4. Written protests pro-tests against the proposed improvements im-provements or against the creation of said District must be presented and filed in the Office of the City Recorder on or before the 16th day of July, 1974, at the hour of 5:00 o'clock .iEiB(iteiiQffil A-l p.m., thereafter at :0U p.m. on said date at the City Council Chambers in Orem City, Utah, any such protests shall be heard and considered by the City Council. The City Recorder is hereby directed to give notice of intention to make the proposed pro-posed improvements and of the time within which protests against the proposed improvements improve-ments or the creation of said District may be filed and the date when such protests will be heard and considered by publishing pub-lishing notice of intention to create Special Improvement District No. 0 of Orem City, Utah County, Utah intheOrem-Geneva intheOrem-Geneva Times, a newspaper published in said City, said notice to be published four times, 'once during each week for four consecutive weeks, the last publication to be not less than five (5) nor more than twenty (20) days prior to the date when protests shall be heard and considered by the City Council. In addition, the City Recorder shall mail a copy of such notice by United States mail postage prepaid to each owner of land to be assessed assess-ed within the proposed special improvement district at the last known address of su"!1 owner, using for such purpose the names and addresses of said owners appearing on the last completed real iproperty assessment rolls of UtahCounty, UtahCoun-ty, and in addition, a copy of such notice shall be mailed postage prepaid addressed to "Owner at the street number of each piece of improved property prop-erty to be affected by the assessment, said notices to be so mailed not later than ten (10) days after the first publication of the notice of intention. Said notice shall be in substantially the following form: NOTICE OF INTENTION PUBLIC NOTICE IS HEREBY GIVEN that on the 11th day of June, 1974, the Mayor and City Council of Orem City, Utah County, Utah passed and adopted a resolution declaring the intention in-tention of creating in said City a Special Improvement District No. O of Orem City, Utah County, Utah. NOTICE IS HEREBY GIVEN by the City Council of Orem City, Utah, of its intention to make thehereinafter described improvements within the said Special Improvement District and of the further intention of said Council to levy special taxes as provided in Article 7, Chapter 7, Title 10, Utah Code Annotated, 1953, on the real estate lying within saidDistrict for the benefit of which such taxes are to be expended in the making of such improvements. The improvements are: to grade and construct or reconstruct re-construct curb, gutters, sidewalks, side-walks, street paving, combination combin-ation driveway approaches, and appurtenant drainage facilities; to install sanitary sewer lines, including manholes and appurtenant appur-tenant structures; toinstallcul-inary toinstallcul-inary waterlines, including fire hydrants and valves; to install irrigation ditch piping with turn outs and other appurtenants; to purchase, condemn, or otherwise other-wise acquire any property in order to make such improvements; improve-ments; to excavate, fill, grade, remove trees, remove nonconforming non-conforming improvements and to do other miscellaneous work necessary to complete the improvements im-provements in a proper workmanlike work-manlike manner. Palisade drive from the north line of 681 South to the South line of 761 South. WATER LINES To excavate for and install 6" water lines on the following streets: Draper Lane from 500 South to 800 South. 650 East Street from 400 North to 350 North. To excavate for and install 8" water lines on the following follow-ing streets: Main Street from 400 South to 800 South. STREET PAVING To excavate, grade and construct con-struct paving andor strip paving as required on the following follow-ing streets: Repave 44 feet wide on 1200 South Street from 400 West to U.S. 91. Repave 44 feet wide on Main Street from 1200 South to 1300 South. Repave 2G feet wide on Main Street from 400 South to 800 South. Repave 26 feet wide on Drapers Dra-pers Lane from the north line of 677 South to 800 South. New pavements 26 feet wide on Draper Lane from 500 South to the North line of 677 South. New pavements 26 feet wide on 700 South from Draper Lane to Palisades Drive. New pavement 26 feet wide on Palisades Drive from the north line of 681 South to the South-line South-line of 761 South. New pave ment 34 feet wide on 900 South Street from the east line of 213 West to 400 West Str66t IRRIGATION DITCH PIPING To remove existing pipes and culverts; to furnish, excavate and install pipe in irrigation ditches, including diversion boxes, head gates and outlets as follows: 1200 South Street from 400 West to U.S. 91. BOUNDARIES OF THE DISTRICT The herein described improvements im-provements shall be called SPECIAL IMPROVEMENT DISTRICT NO. Four inch thick concrete driveways will be installed as a part of the improvements only at the option and request of the property owner, made in writing wri-ting to the City Recorder on or before construction of such improvements is commenced. If so requested and installed, the cost will be assessed against the property benefited, in addition addi-tion to the assessment for other improvements. All non-conforming improvements improve-ments such as lawns, sprinkling systems, rock gardens, driveways, drive-ways, curbs, sidewalks, walls, fences, trees, asphault, etc. which are located within the area to be improved shall be removed by the property owners own-ers or at their expense prior to construction of the improvements, improve-ments, and if not so removed, will be removed by the contractor contract-or as part of the project and the cost thereof may be assessed against the abutting property in addition to the assess ment for other purposes. There shall be an allowance for corner lots to be apportioned as defined and provided for in the ordinance of Orem City, Utah, and the laws of the State of Utah. The assessments are pavble in ten (10) equal annual installments install-ments with interest on the unpaid un-paid balance of the assessment of not to exceed eight per cent (8) per annum from the effective effect-ive date of the ordinance levying the assessment until due; provided pro-vided one or more installments on the whole assessment may be paid without interest within fifteen fif-teen (15) days after the ordinance ordin-ance levying the tax becomes effective. Default in the payment pay-ment 'of any installment of an assessment shall cause the whole of the unpaid principal and interest to become due and payable immediately and the whole amount of the unpaid principal shall thereafter draw interest at the rate of ten per- cent (10Tt) per annum until paid. A map of the proposed District Dis-trict is on file in the Office of the City Recorder, and all persons per-sons interested are hereby re-. re-. ferred to the same for further information in regard to said Improvements and said Special Improvement District. TIME FOR FILING PROTESTS Any objections to the proposed pro-posed improvements or to the creation of the District shall be in writing, signed by the owner or owners of the property fronting front-ing or abutting on or adjacent to the streets or alleys to be improved im-proved or especially affected or beefited by such improvements, improve-ments, with a description of such property t,M, block, ert.) and the number of front feet thereof, and shall be filed with the City Recorder of OremCity, Utah on or before 5:00 o'clock p.m. on July 16, 1974, There-alter, There-alter, at 8:00 o'clock p.m. on July 16. 1971, the City Council will meet at the City Hall to hear and consider any such objections to the proposed improvements im-provements or to the creation of the District.
