ORDINANCE NO. 175 AN ORDINANCE AMENDING THE REVISED ORDINANCE OF OREM CITY, UTAH 1959 AND MORE PARTICULARLY CHAPTER CHAP-TER III OF THE ZONING ORDINANCE OR-DINANCE OF OREM CITY, UTAH, AS AMENDED, RELATING RE-LATING TO ZONES AND REGULATIONS REG-ULATIONS WITHIN ZONES. BE IT ORDAINED BY THE CITY COUNCIL OF OREM CITY, UTAH: Section 1: That Section 29-3-1-7 of Chapter III of the Zoning Ordinance of Orem City, Utah, be and the same is hereby amended, modified, and changed to read as follows: 29-3-1-7. Size of Buildings The ground floor area of any one-family dwelling shall be not less than one thousand (1,000) square feet exclusive of open porches and carports. For other buildings there shall be no requirements. Area Requirements An area of not less than 7,500 square feet shall be provided and maintained for each one-family dwelling and not less than 8,500 square feet for each two-family dwelling. Section 3: That Section 29-3-2a-4 of Chapter III of the Zoning Ordinance of Orem City, Utah, be and the same is hereby amended, modified, and changed to read as follows: 29-3-2a-4. Frontage Requirements The minimum width of any dwelling site shall be 75 feet for any one-family dwelling and 85 feet for any two-family dwelling. For church sites the minimum width of lot shall be 150 feet. Section 4: That Section 29-3-2a-7 of Chapter III of the Zoning Ordinance of Orem City, Utah, be and the same is hereby amended, modified, and changed to read as follows: 29-3-2a-7 Size of Buildings The ground floor area of any one-family dwelling shall be at least 900 square feet exclusive of open porches and carports. The floor area of any two-family dwelling shall be not less than 1,650 square feet exclusive of open porches and carports. Section 5: That Section 29-3-3-7 of Chapter III of the Zoning Ordinance of Orem City, Utah, be and the same is hereby amended, modified, and changed to read as follows: 29-3-3-7 Size of Buildings The ground floor area of any one-family dwelling shall be at least 750 square feet. No dwelling unit shall have a total floor area of less than 750 square feet except ex-cept that up to one half of the dwelling units on a lot may contain con-tain less than 750 square feet, but not less than 500 square feet, provided the total floor area in any building containing dwellings shall be not less than 750 square feet multiplied by the number of dwelling units in the building. Section 6: That Section 29-3-3a-4 of Chapter III of the Zoning Ordinance of Orem City, Utah, be and the same is hereby amended, modified, and changed to read as follows: 29-3-3a-4. Special Provisions A. At least 70 per cent of the required front yard and side yard which abuts upon a public street shall be landscaped with lawn, shrubs, and trees. On lots on which a building containing more than a four family dwelling is constructed, parking space shall be so arranged that adequate access to solid waste storage facilities by city trucks shall be maintained at all times as determined by the Zoning Administrator. Ad-ministrator. In no case shall access ways be less than 15 feet in width. Such solid waste storage facility shall be located where it cannot be seen from a public street or else a screen or sight-obscuring sight-obscuring fence or wall must be constructed which will prevent the solid waste storage facility from being seen from a public street. B. A concrete curb shall be constructed at the border of all offstreet parking spaces. C. A landscape strip at least five feet in width shall be constructed con-structed and maintained between curbs bordering offstreet parking spaces and boundaries of the lot except for driveways. Section 9: That Section 29-3-4-7 of Chapter III of the Zoning Ordinance of Orem City, Utah, be and the same is hereby amended, modified, and changed to read as follows: 29-3-4-7. Size of Buildings The ground floor area of any dwelling, child or foster care home, rest or nursing home, or other building used primarily for living purposes shall contain at least 900 square feet of floor space, exclusive of open porches and carports, plus 100 square feet for each guest room. Section 10: That Section 29-3-7-3 of Chapter HI of the Zoning Ordinance of Orem City, Utah, be and the same is hereby amended, modified, and changed to read as follows: 29-3-7-3 Area Requirements A lot area ot not less than 6,500 square feet shall be provided pro-vided and maintained for each one-family dwelling. Apartment houses containing more than one dwelling unit shall have a lot area of not less than 6,500 square feet plus 1300 square feet of lot area for each additional living unit. Schools and churches shall have a building site area of not less than 6,500 square feet plus three additional square feet of lot area for each square foot of floor space in excess of 1,000 square feet contained within the building. Section 11. That Section 29-3-7-4 of Chapter III of the Zoning Ordinance of Orem City, Utah, be and the same is hereby amended, modified, and changed to read as follows: 29-3-7-4. Frontage Requirements The minimum width of any building site for a dwelling apartment house or other building used as a living unit shall be 65 feet. For other uses there shall be no width requirement. Section 12: That Section 29-3-7-7 of Chapter III of the Zoning Ordinance of Orem City, Utah, be and the same is hereby amended, modified, and changed to read as follows: 29-3-7-7. Size of Buildings No dwelling unit shall have a floor area of less than 750 square feet except that up to one half of the dwelling units in a building containing two or more dwelling units may contain less than 750 square feet but not less than 500 square feet, provided the total floor area in any such building shall be not less than 750 square feet multiplied by the number of dwelling units in the building. Section 13: That Section 29-3-7-8 of Chapter III of the Zoning Ordinance of Orem City, Utah, be and the same is hereby amended, modified, and changed to read as follows: 29-3-7-8. Special Provisions A. All materials and merchandise, mer-chandise, except vehicles in running run-ning order, shall be stored in an enclosed building or within an enclosure surrounded by a sight-obscuring sight-obscuring fence or wall of not less than six feet in height and no material or merchandise shall be stored to a height of more than the enclosing fence or wall. B. Storage of junk, partially or completely dismantled automobiles, auto-mobiles, or salvage materials shall be prohibited in the C-3 Zone. C. For any building containing dwellings on the ground floor at least 70 per cent of the area contained within a required front yard and side yards which abut upon a public street shall be landscaped with lawn, shrubs, and trees andor other ornamental features. D. On lots on which buildings containing con-taining four or more dwelling units are constructed, solid waste storage facilities shall be provided and located so that access to the facilities by city trucks can be maintained at all times, as approved by the zoning administrator. In no case shall access way be less than 15 feet in width. Such solid waste storage facilities shall be located at the rear of the main building or else behind a sight-obscuring fence or wall which will prevent the facility from being seen from a public street. E. Planting areas shall be separated from offstreet parking area and driveways by a concrete curb or other material approved by the Zoning Administrator. F. That Section 29-3-10 of Chapter III of the Zoning Ordinance of Orem City, Utah, be and the same is hereby amended, modified, changed, and enlarged by adding a new paragraph to said Section 29-3-10. Said section shall read as follows: 29-3-10-14. A. Landscaping Required At least seventy percent (70) of the area contained within a required re-quired front or side yard adjacent ad-jacent to a street in any residential zone shall be landscaped land-scaped with lawn, shrubs, trees, andor other ornamental features. fea-tures. Within any commercial zone the strip of land between the back of the curb and the lot line, exclusive of sidewalks shall also be so landscaped as well as other areas specifically set forth in this ordinance. B. Purpose The purpose of the landscaping requirements in this ordinance shall be to enhance, conserve, and stabilize property values by encouraging pleasant and attractive at-tractive surroundings and thus create the necessary atmosphere for the orderly development of a pleasant community. Landscaping Land-scaping also contributes to the relief of heat, noise, and glare through the proper placement of green plants and trees. C. Standards and Requirements Require-ments 1. Plot Plan Required Where landscaping is required in connection with a commercial building or a building containing four (4) or more dwelling units, a planting plan showing the location and species of all plant material together with a plan for a sprinkler irrigation system shall be submitted to the Zoning Administrator. The same plot plan used to show parking layout or other requirements for the issuance is-suance of a building permit may be used to show, landscaping, provided all proposed landscaping land-scaping is detailed adequately on said plot plan. The Zoning Administrator may disapprove such plans if he determines that they are not consistent with the requirements and purposes of this Ordinance. 2. Maintenance Required landscaped areas shall be maintained in a neat, clean, orderly, and healthful condition. con-dition. Default In the event the builder defaults de-faults or fails or neglects to satisfactorily install the required landscaping within one year from the date of issuance of the certificate cer-tificate of occupancy, the city manager may declare the bond or other assurance forfeited and the City may install or cause there-quired there-quired improvements to be installed in-stalled using the proceeds from the collection of bond or other assurance to defray the expense thereof. b. Final Disposition and Release Re-lease The Builder shall be responsible re-sponsible for the quality of all materials and workmanship. At the completion of the work, or not less than ten days prior to the release date of the bond or other assurance, the Zoning Administrator shall make a preliminary inspection of the improvements im-provements and shall submit a report to the city manager setting forth the conditions of such facilities. If the quality of the work is found to be satisfactory, satis-factory, the city manager shall release the bond or other assurance. as-surance. If plant materials have died or the conditions of material or workmanship shows unusual depreciation or does not comply with acceptable standards of quality the city manager may declare the builder in default. c. Continuing Obligation It shall be the obligation of the owner of the building or his assigns or successors to continue to maintain the landscaping in accordance with good landscape years Orem-Geneva Times practice. Failure or neglect to do so shall constitute a violation of this ordinance. d. Non-Conforming Status Any use of property, which, on the effective date of this ordinance, or-dinance, is non-conforming only as to the regulations relating to landscaping may be continued in the same manner as if the landscaping land-scaping were conforming. e. Landscaping Defined For the purpose of this ordinance, landscaping shall mean the application or use of some combination of planted trees, shrubs, vines, ground cover, flowers, or lawns. In addition, the combination or design de-sign may include rocks and such structural features as fountains, pools, art works, screens, walls, fences, or benches, but one of these subjects alone shall not meet the requirements of this ordinance. The selected combination com-bination of objects for landscaping land-scaping purposes shall be arranged ar-ranged in a harmonious manner as determined by the Zoning Administrator. Section 15: That if any part of this ordinance shall be declared de-clared invalid, such decision shall not affect the remainder of this ordinance. Section 16: That all ordinances or parts of ordinances in conflict con-flict herewith are hereby repealed. re-pealed. Section 17: That any person violating any provisions of this ordinance shall be guilty of a mis-demeanor mis-demeanor and upon conviction thereof shall be punished by a fine in any sum not exceeding $299.00 or by imprisonment for a period of six months or by both fine and imprisonment. Each and every day such violation shall be continued shall be considered a separate offense. Section 18: Because of impending im-pending development withinOrem City, Utah, an emergency exists. In order to preserve the health, safety, convenience, and general walfare of the city of Orem thereof, this ordinance shall take effect upon its passage and first publication in the Orem-Geneva Times, a newspaper of general circulation in the city.
