SUMMIT COUNTY ORDINANCE NO. 264 AN ORDINANCE APPROVING THE CONSENT AGREEMENT FOR THE PIPER IMPACT EXPANSION OF PHASES TWO, THREE AND OFFICE ADDITION PROJECT WHEREAS, the owners and developers of Piper Impact Inc. have applied for site plan approval for the construction of the 72,764 square foot addition to their existing manufacturing plant and office space, located in the Silver Creek Commerce Center, which was approved on August 5, 1991; and WHEREAS, Summit County, acting pursuant to its authority under Utah Code Ann. 17-27-101, et seq.. has made certain determinations with respect to the proposed project and, in the exercise of its legislative discretion, has elected to process the project pursuant to 14.1, et seq. of the Administrative Guidelines, resulting in the negotiation, consideration and approval of this Consent Agreement after all necessary public hearings; and WHEREAS, it is in the best interests of Summit County and the health, safety and general welfare of its citizens to adopt this ordinance in order to resolve certain disputes between the parties with respect to the proposed construction of the addition Project, based on the terms and conditions as more fully set forth in the Consent Agreement. NOW, THEREFORE, the County legislative body of the County of Summit, the State of Utah, ordains as follows: Section 1. Ordinance No. 264, The Consent Agreement for the Piper Impact Addition Project, Summit County, Utah, consisting of 9 pages including exhibits which has been published as a code in book form, three copies of which have been filed for use and examination in the office of the Clerk of Summit County, Utah, is hereby adopted by Summit County, and the Chairman is authorized to sign and execute the Consent Agreement on behalf of Summit County. Section 2. This ordinance shall take effect 15 days after passage by the Board of County Commissioners of Summit County and subsequent publication in a newspaper of general circulation in Summit County, Utah.
