Billings, a partner with the Salt Lake City firm of Van Cott, Bagley, Cornwall & McCarthy, was reelected to the American Judicature Society Board of Directors at the Society's annual meeting August 8 in San Francisco. "I am honored to be reelected to the AJS Board of Directors," said Billings. "One of the most exciting areas we are currently exploring is how to make legal remedy more accessible to the citizenry," he said. Mr. Billings is a member of the American Bar Association's Consumer Financial Services, Deposit Account, Business Bankruptcy and Interstate Banking committees; and he chairs the Utah State Bar Character and Fitness Committee, Ethics and Discipline Committee, Judicial Advisory and Law Related Education Committee. A graduate of Brown University and the University of : S . . Ki Tom Billings Utah College of Law, Mr. Billings is a past chair of the Utah State Bar Bankruptcy Section and has served as president of the Brown Club of Utah since 1980. His most recent articles, "Basic Bankruptcy in Utah" and "Creditors' Rights in Utah," were published by the National Business Institute. Founded in 1913, the American Judicature Society is a national independent organization of more than 20,000 concerned citizens working to improve the nation's justice system. Among its goals are creating greater public understanding of the role of the courts, selecting judges for their professional qualifications, protecting judicial independence while maintaining the highest standards of judicial ethics, and improving court systems. AJS publishes newsletters, monographs, and the journal, Judicature, holds conferences and seminars, maintains an information and consultation service, conducts empirical research, and operates the Center for Judicial Conduct Organizations. Council certifies judges for retention Sixteen Utah judges will appear on the ballot this November. Utah voters are asked to choose whether or not to retain the judge in office. This procedure is different from most Utah elections where offices are "contested" (more than one candidate for each office). Judges do not campaign and compete against others for their offices, because the people and legislature of Utah decided several years ago that judges could do their jobs better if they were not pressured to make campaign promises to particular groups, or to fear an electoral rival if they made a decision that some people didn't like. If a majority of voters decide not to retain a judge, the local nominating commission (appointed by the governor and the bar with politically balanced representation) would announce an opening, and interview applicants. The top three names would then be sent to the governor for his selection. How can a voter find out about the performance record of judge standing for retention election? In 1986 the legislature passed a law directing the "Utah Judicial Council (the group of judges that makes policy for the courts) to report the results of the judicial evaluation program to the public 90 days before each election. The Council recently released to the press its report on judges who will be on the 1992 ballot. The Council certified all 16 judges who filed for retention election this year. The Judicial Council Evaluation Reports on each judge up for election are available at the Administrative Office of the Courts in Salt Lake City, 578-3828. 578-3828. The criteria used to evaluate each of the 16 judges included the following: -The judge's physical and mental ability to serve another term; -The judge's compliance with the Code of Judicial Conduct; -A review of any formal or informal sanctions imposed by the independent Judicial Conduct Commission; -Compliance with Supreme Court Rules; -The number of cases retained under advisement longer than 60 days; -The results of a poll of attorneys who had recently practiced before that judge. This poll was conducted by Dan Jones and Associates during September and October of 1991. -The completion of 30 hours of judicial education each year; -Additional supporting material relating to a judge's off-bench service to Utah's judiciary and to the larger community. Judges who fail to meet one or more of these criteria may appear before the Judicial Council and show cause why they should still be certified. Council members will then vote on whether or not the judge's defense of his or her record was convincing enough to merit certification. A judge who is not certified by the Judicial Council may still choose to file for election and appear on the retention ballot but will do so without the Council's endorsement. The Council's performance evaluation program is still evolving. It has been and is being developed by a special committee of lawyers, private citizens, and judges. Additional elements have been added to the program for the judges facing the voters this year, compared to the evaluation reports released in 1990, and other performance factors are being considered for future evaluations. This year, one Supreme Court Justice, Richard C. Howe, will be on the ballot statewide. The remainder will appear on the ballots in the counties they serve. State Fair deadline for arts entries The 1992 Utah State "Fair For All Reasons" announces entry deadlines and information for all Creative Arts and Home Arts Entries. Entries will be received September 3 from 10 a.m. to 5 p.m., September 4 from 10 am. to 7 p.m. and September 5 from 10 a.m. to 5 p.m. Candy, yeast breads, cookies and wedding cake entries will be received only on September 9 from 8 a.m. to 12 noon. No pre- entry is required for any category. Categories and entry fees for Creative Arts are: Professional, $3.00; Advanced, $2.50; Amateur, $2.00; Junior (age 8-12) , $2.00; Senior Citizen (age 62), $2.00; Disabled (over 8 yrs. old), no charge. New this year in Creative Arts is a division for decorative wreaths. A special award offered by Meredith Press will be given in the wreath division. Home Arts entry fee is $1.50 for every three items entered. Categories include Professional, Open, Youth (age 16 and under), Senior Citizen (age 75 and older) and Disabled. New awards will be offered this year for rug hooking and home canning. For more information call 538-FAIR.
