CAN wm 1 pC 29 LEGAL ORDINANCE NUMBER 5-73 AN ORDINANCE VACATING A PARCEL OF LAND OWNED BY SPRINGVILLE CITY KNOWN AS THE "NORTH PARK" FOR PUBLIC PARK AND RECREATIONAL PURPOSES AND PROVIDING FOR THE SALE OF THE SAME TO MAYTEX MANUFACTURING MANUFAC-TURING COMPANY, INC., FOR INDUSTRIAL PURPOSES. PUR-POSES. BE IT ORDAINED BY THE CITY COUNCIL OF SPRINGVILLE, UTAH: SECTION 1. Springville City acquired by purchase in the year 1955 the following described parcel of land. South 566.575 feet and East 817.313 feet (based on the Utah State Coordinate System, Central Zone) from the West Quarter corner of Section 28, Township 7 South, Range 3 East, of the Salt Lake Base and Meridian: thence along a fence line as follows: North 85 deg. 49 min. 48 sec. West 422.493 feet: North 4 deg. 10 min. 12 sec. East 75.3 feet; and North 85 deg. 49 min. 48 sec. West 50.0 feet to a fence corner; thence North 1 deg. 14 min. 33 sec. West 352.863 feet to a fence line; thence along a fence line as follows: South 85 deg. 45 min. 16 sec. East 506.861 feet; South 86 deg. 01 min. 26 sec. East 465.878 feet; South 0 deg. 27 min. 07 sec. East 429.927 feet; and North 85 deg. 42 min. 44 sec. West 501.604 feet -to the point of beginning. Containing 9.420 acres. SECTION 2. The purchase price for said parcel of land was ' obtained largely through efforts of the citizens of the community and contributions; and since its acquisition said parcel of land has been used for public and private recreational purposes. SECTION 3. Because of the location of the land near the north end of the corporate limits of the City, and because of limited access to the land and dangers to both pedestrian and vehicular traffic inherent in crossing and traveling along U. S. Highway 91, many citizens of the community have in the past expressed opinions that the area was undesirable for public recreational purposes. SECTION 4. For a number of years the land has been zoned for commercial and industrial uses, and all utility services' are available at the site. The Springville City Council is of the opinion that the highest and best use for the land is for industrial uses, and that it should be made available for such purposes. SECTION 5. For the purpose of achieving greater industrial development in the city of Springville which the City Council believes will benefit the City, the City Council has determined that said land should be sold for industrial purposes. Therefore, the City Council of Springville hereby declares said land vacated as a public park and recreational area. SECTION 6. The City Council . of Springville hereby approves the sale of said 9.420 acres of land to Maytex Manufacturing Company, Inc., for the sum of $37,680.00 cash, to be paid upon delivery of the deed conveying title, subject to the following ' provisions: (a) The City shall reserve a right of way for electrical transmission lines and necessary poles and appurtenances ap-purtenances along the west line of the parcel of land conveyed. (b) The right to the possession and use of the east 500 feet (approximately) of the land conveyed upon which an existing baseball and football field is being utilized by the City in its recreation programs for the youth of the community shall be retained by the City without charge to it until such facilities have been relocated and removed by the City, provided that Maytex may terminate the City's right to possession and use of that part of the land at the end of any year after the year 1973 by giving the City written notice of such termination ter-mination at least six months prioF to the end of such year. (c) If construction of Maytex's industrial facilities on the land conveyed is not begun during the year 1973, the City, at its option, and in the absence of any other agreement with Maytex to the contrary, may repurchase re-purchase the land for the same price as the same is sold hereunder. SECTION 7. The Mayor and City Recorder of Springville are !ereby authorized and directed to make, execute, acknowledge and deliver to Maytex Manufacturing Company, Inc., upon receipt of the purchase price, a good and sufficient warranty deed conveying title to Maytex, subject to the provisions in the next preceding section; and the City Council hereby ratifies and approves all that the said Mayor and City Recorder have done or may do pursuant to this authorization. I NOTDCE SECTION 8. The City Council of Springville acknowledges its responsibility to the citizens of Springville to replace said public park and recreational area with adequate facilities equal to or better than those at the "North Park"; and hereby declares that the funds received from the sale of the aforesaid land shall be deposited in the City's capital improvement fund to be expended ex-pended only for the purpose of acquiring land and making improvements thereto which will replace the facilities at the "North Park". SECTION 9. The City Recorder of Springville is hereby directed to cause this Ordinance to be published in the July 19, 1973, issue of the Springville Herald, a newspaper published in Springville, Utah. For a period of thirty days thereafter, any person in interest shall have the right to contest the legality of this Ordinance and the sale of the land aforesaid; but after said time, no one shall have any cause of action to contest the regularity, formality or legality thereof for any cause whatsoever. what-soever. SECTION 10. This Ordinance shall go into effect upon its passage as to those acts which the Mayor and City Recorder1 are directed and authorized to do, subject only to the provisions of the next preceding section; and on the thirtieth day after its publication as to all other matters. Smiling so prettily for us here is Tara Dawn Tanner, daughter of Mr. and Mrs. Lon (Karen) Tanner, of this city. She celebrated her first birthday birth-day Tuesday. July 10th. Her grandparents are Mr. and Mrs. Bill Stevenson and Mr. and Mrs. Dale Tanner, all of Springville. This cute smile is on the face of Shad LaRay Dallin, son of Mr. and Mrs. Keith L. Dallin. He is the fourth generation of the family to carry that name LaRay, and he was one year old Thursday, July 12th. His grandparents are Mr. and Mrs. Robert G. Bird and Mr. and Mrs. Max L. Dallin, all of Springville. Pigeons were once so numerous in the United States that they were a menace to crops, and a constant source of annoyance to farmers. One method of getting rid of them was to catch a pigeon and fasten it to a "call stool" in the field. When the other pigeons flocked around the decoy, it derived our expression, "stool pigeon."
