Show ORDINANCE NO. 419 AMENDING TITLE 17, PLANNING AND ZONING, TO CLARIFY HEIGHT REGULATIONS. WHEREAS, the height regulations of Title 17, Planning and Zoning, need to be clarified; BE IT ORDAINED BY THE CITY COUNCIL OF KAYSVILLE CITY, UTAH: 1. Subsection 17-2-2 Building Height of the Land Use Code is -amended to clarify the definition and to read as follows: fol-lows: Building Height - The vertical distance dis-tance from the finished grade of the ground to the highest point of the structure. 2. Section 17-25-2 of the Lane Use Code is amended to clarify the height limit exceptions and to read as follows: 17-25-2 Height Limit Exceptions. (1) Roof structures for the housing .of elevators, stairways, tanks, ventilating ven-tilating fans, or similar equipment required to operate and maintain the building, skylights, steeples, flagpoles, chimneys, or similar structures may be erected above the height limits herein prescribed, but no space above the height limit shall be allowed for the purpose of providing pro-viding additional floor space. (2) On a pitched or hipped roof that extends upward from within twelve feet of the finished grade, the building height shall be measured to the average height of the highest gable. (3) No main building shall be erected to a height less than ten (10) feet. 3. This Ordinance shall take effect upon the date of publication thereof, one time only, in the Clipper.
