Show OIL COMPANY SUES COUNTY ON ZONE ORDINANCE Chevron Oil Company (the Standard Oil Co. of California) Califor-nia) has filed suit in Fifth District Court against the Bae-ver Bae-ver County Commission, seek- -ing to have the Beaver County Zoning Ordinance declared unconstitutional. un-constitutional. Specifically, the complaint alleges that the zoning regulation regu-lation is "unreasonable, capricious, capri-cious, discriminatory, oppressive, oppres-sive, illegal and void"; that it is not within the police power of the defent (county commission) commis-sion) to adopt or enact the resolution; and that it "deprives the plaintiff of the use of its property without compensation therefor." The suit resulted from the refusal of the county commission commis-sion to zone the sagebrush and juniper covered land near the Cove Fort interstate highway high-way junction for commercial purposes. The oil company and associates planned to construct roadside services at the interchange inter-change including gasoline services, serv-ices, food and lodging. It is contended that the refusal to zone the area for roadside services is to "protect" "pro-tect" 'the Beaver City business busi-ness men who have large investments in-vestments in similar services. |
