R. Whitehead & Son, a Corporation, Plaintiffs, vs. J. L. Griffith Company, Com-pany, a Corporation, New Jersey Fidelity & Plate Glass Insurance Co a Corporation, The Dixie Stock-growers Stock-growers Bank of St. George, Utah, a Corporation, Midvale State Bank, a Corporation, Ivor Ajax, as State Auditor of the State of Utah, and A E. Christensen, as State Treasurer of the State of Utah, Defendants. To all creditors of and claimants claim-ants against J. L. Griffith Co., a Corporation, and New Jersey Fidelity Fidel-ity & Plate Glass Insurance Co., a Corporation, and to all persons holding hold-ing claims for labor performed and materials and supplies furnished and used in the prosecution of, and carrying car-rying on, the work of Federal Aid Project No. 80-A. you and each of you are hereby notified that the above named plaintiffs plain-tiffs have commenced an action against the above named defendants defend-ants in the above entitled Court, under un-der Sec. 5753 Compiled Laws of Utah, 1917, which action is pending therein, wherein plaintiffs seek to recover judgments against said J. L. Griffith Co. as contractor and said New Jersey Fidelity & Plate Glass Insurance Co. as surety under Federal Fed-eral Aid Project No. 80-A, for themselves, the said plaintiffs, and for the use and benefit of all persons per-sons holding claims for labor performed per-formed and . materials and supplies furnished and used in the prosecution prosecu-tion of, and the carrying on, of said work, for which payment has not been made. You are further notified that you have a right to intervene in said action and file your claim herein at any time within two months from the last publication of this notice; and that all such claimants, creditors and persons who do not intervene in-tervene in this cause within the time herein provided for and file their claims in this action, shall be forever for-ever barred fromi recovery on the bond of the above named defendant defend-ant New Jersey Fidelity & Plate Glass Insurance Company given to secure the faithful performance of said work and- the payment of all claims of sub-contractors, laborers, mechanics, materialmen, ranchmen, farmers, merchants, and any other person or persons who supply the principal andor any of the subcontractors sub-contractors of the principal with labor, la-bor, work, material,' ranch or farm products, provisions, goods and supplies sup-plies of any kind including tools, machinery and equipment to the extent of their use and depreciation deprecia-tion of this contract, all just debts incurred therefor in carrying on such work.
